Demand transparency and compensation for personal data use

The Issue

In today's rapidly advancing digital world, providing personal information is becoming a prerequisite for accessing a wide array of services, ranging from applying for jobs to simply navigating online platforms. While some companies have made efforts to disclose whether they sell personal data, many have been less forthcoming, either initially concealing or failing to communicate these practices altogether. The lack of transparency and accountability leaves consumers vulnerable to misuse of their data and deserving of compensation for their contributions.

Statistics reveal an alarming trend. For example, in 2021 alone, data breaches exposed over 1.1 billion individuals globally, a number that highlights the risks associated with inadequate protection and misuse of consumer data (Source: Statista, "Number of data breaches and exposed records in the United States from 2005-2022") . Every time personal data is collected, it holds intrinsic value. This value, often monetarily beneficial to corporations, rarely translates into benefits for the individuals from whom the data is sourced.

To address this imbalance, we call on lawmakers to require all companies that have collected personal data over the last 25 years to monetarily compensate consumers based on their economic gains, with a minimum of $200 to each individual. Just as critically, current businesses should be mandated to establish transparent and fair compensation models for ongoing data collection, giving consumers the clear option to either agree, or opt out. This compensation should also reflect the economic gain companies experience from utilizing consumer information.

In the case of a data breach, where any consumer’s data is compromised, we demand consumers instantly be awarded $2,000 minimum each for damages, potential dangers and emotional distress. This will apply to both private, and public sectors. Any companies that have already had their data breached, and not already been found guilty, or not already reached a settlement with the victims from the last 25 years will begin paying these out until they are completely done and accounted for. 

Furthermore, we urge for the establishment of a regulatory body responsible for monitoring, enforcing, and ensuring compliance with these compensation practices. This body should be bestowed with adequate power and resources to levy fines and sanctions against those who violate data rights, thus providing a layer of security for all consumers.

Privacy is a right, not a luxury. In a world where data equates power, it is imperative to protect individuals from exploitation and ensure that they are rightful beneficiaries of the profits derived from their personal information.
