Demand Action


We wanted to explain a little more of what we have learned and we will update to this petition some of the insurance to give a better understanding.  There have been those questioning about why not an attorney at this point.  Our insurance aside as we have consulted with many attorney’s and are currently still consulting, there are a lot of breakdowns with this.  
With a City, things are not simple.  For starters, you have to ask permission to take them to court.  They are also capped at what they are liable to pay.  That cap is $100,000.  Then, is the city self insured or insured by a third party.?  
In this case, the city of Richardson has a third party policy with Travelers.  The very first week the city was notified a claim could have been filed, but instead the city waited 14 months, when their own policy has a deadline of 6 months.  (Will leave that to your own opinion of dirty) 
The laws protect the city and their premiums, Not Yours!!  Technicalities and flaws can be fought under direct negligence.  This petition goes further and by taking a stand it protects you as a homeowner so that this city primarily, but also other cities cannot just go run crazy at your expense.  
We have been told by attorneys that this was one of the clearest cases against a city they had seen in a long time, but the math does not help.  If it is a straight law suit against torts it will cost a firm (even in a clear case like this) around $70,000 to fight the city in court and they would only be liable for $100,000.  In the end there would be nothing left.  
This is what you are protecting and standing for!!
We have had multiple private adjuster firms and civil engineers look into our case.  We even had an engineering firm use our story to show what can happen. In the beginning of this nightmare we were told damage would exceed over $110-$120,000.  That coupled with delays, product pricing overages, finding product, labor, etc. all associated from the pandemic and then rent exploding upward the numbers become clear.  
There are obviously bads on our insurance as well, but I always revert back to fault to prevent and protect and change how this is done.  
You should want this change as we would never warrant this nightmare on anyone. 
The city has told a local anchor there was no thirty party report to give, but yet the city had vehicles and personnel in the area prior to and after this flood.  They admitted in email that they responded to our flood within days, but yet there was no report to give.  Cities don’t operate like that and lack of transparency is a very very big issue here.  

Stand up against this!!!
