The Issue

This petition stems from a deeply personal story. Over 20 years ago, my brother faced a charge of Romeo and Juliet, serving his time and vowing never to return to prison. However, when he found himself accused by an ex-girlfriend with a vendetta, fear drove him to desperate measures. His lawyer told him he couldn't win because the prosecution would use his old record against him.

This is not an isolated case. Many individuals who have served their time and stayed out of trouble for decades find their past crimes used against them in court, influencing juries unfairly and tipping scales towards conviction. This practice undermines the very essence of our justice system which is built on principles like rehabilitation and second chances.

According to The Sentencing Project, as many as 77 million Americans have a criminal record (The Sentencing Project). It's crucial that we ensure these individuals are not perpetually punished for mistakes they've already paid for.

We call upon lawmakers to enact reforms that prevent prosecutors from using records older than 20 years in court proceedings if the individual has had no further legal trouble since then. This will ensure fair trials without undue influence on juries based on past convictions.
