Demand Justice for Man Jailed Over False Walmart Kidnapping Claim in Cobb County

The Issue

Mahendra Patel spent 45 days in jail over an accusation that never should have led to an arrest.

In March 2025, Patel was shopping at an Acworth Walmart when a mother claimed he tried to kidnap her child. She said he grabbed the toddler from her arms after asking for help finding Tylenol. But Patel always maintained he only reached out because he saw the child slipping off the motorized scooter the mother was riding. He thought the child was about to fall — and tried to help.

Instead of reviewing the full context or confirming evidence, police arrested him, denied him bond, and brought serious charges. Patel sat in jail for over six weeks. Surveillance footage and additional investigation later confirmed his innocence, and the charges were dropped. But the damage was already done.

This isn’t just one man’s nightmare — it’s a failure in how we treat accusations and investigate intent. It’s a warning about what can happen when fear and assumption override facts. And it raises deep questions about how easily someone — especially a person of color — can lose their freedom with no real proof.

We’re calling on Cobb County officials and state leaders to review how this case was handled and to implement safeguards that prevent people from being jailed without proper evidence. Patel didn’t deserve what happened to him. No one does. His arrest, indictment, and detention happened before the truth was even fully investigated — and that’s not justice.

Patel is now free, but he says he’ll never see the world the same way again. A man who once offered help now thinks twice before approaching anyone in need. That’s what this system did to him.
