A news article has resurfaced published by the Gainesville Daily Register July 12th 2007.
District Judge Janelle Haverkamp was overruled by 9 judges of the Texas Court of Criminal Appeals (the states highest court to decide criminal cases) and that Janelle was "without authority to order certain discovery sought by criminal defendants."
Cooke County's Then District Attorney Cindy Stormer asked the Court of Appeals of the 2nd District to rule on about 44 different items and also ruled that Stormers office, "...pay for ALL COSTS of this proceeding."
The Fort Worth District Court Denied Stormers Petition and labeled DO NOT PUBLISH
Pursuing the 64 page document that Stormer's office created the court ruled denying the district attorney's petition for relief 40 times and against the district judges request for discovery 4 times.
Stormer appealed that decision to the Court of Criminal Appeals in Austin.
Stormer Filed a Writ of Mandamus.
A Writ of Mandamus is an extraordinary remedy that compels a government officer or entity to perform a duty they are legally obligated to fulfill. It is an original appellate proceeding that seeks extraordinary relief. The writ is issued by a court or judge of competent jurisdiction, directing someone to produce a person in custody or restraint and show why they are being held.
ALL INFORMATION PRESENTED IN THIS PETITION IS PUBLIC DOCUMENTS.
Cooke County Janelle Haverkamp has shown to be egregious and nothing has been done about it.
THIS PETITION CALLS FOR HAVERKAMP TO STEP DOWN OR THE STATE TO HAVE HAVERKAMP REMOVED IMMEDIATLY AND ALL CASES/RECORDS INVESTIGATED FURTHER. Records indicate nothing was done because again it was stated that this is a political vendetta against Haverkamp. WE ask that someone comes in from outside of the North Texas Region/higher authority to come in and further investigate these egregious actions.
excluding/not limited to current and former Constituents of Haverkamp from TARRANT COUNTY, DENTON COUNTY, GRAYSON COUNTY
We are currently waiting on the court's decision to remove Haverkamp any day now as it was stated it would be 10 for the decision.
