This petition is initially directed to the U.S. Department of Health and Human Services (HHS), urging the establishment of enforceable federal guidelines to ensure timely access to diagnostics and specialist referrals.

Once we build momentum, we will extend our efforts to include state legislators for localized implementation and Congressional Committees, such as the Senate Health, Education, Labor, and Pensions Committee and the House Energy and Commerce Committee, to pursue nationwide legislative reforms.

Our focus on HHS as the starting point provides a robust foundation for systemic change. By advocating for federal guidelines, we aim to establish clear timelines and accountability measures that can cascade to state and local levels, transforming healthcare access across the U.S.

The current U.S. healthcare system lacks clear definitions of "timely" access to diagnostic tests and specialist referrals, leading to harmful delays in patient care. For many, vague diagnoses without thorough evaluations delay life-saving interventions for conditions such as cancer, cardiovascular emergencies, or neurological crises. These oversights cause prolonged suffering, unnecessary progression of conditions, and, in some cases, preventable fatalities.

Through enforceable timelines and accountability measures, we can address these gaps and ensure that every patient receives timely, accurate care—a right that should never be negotiable.

Ambiguity in Timelines Leads to Delays
The lack of clear, enforceable timelines for referrals, diagnostic testing, and specialty appointments creates significant gaps in patient care. Patients often face:

Another barrier to timely and accurate diagnoses is the denial of referrals by healthcare providers without conducting in-person evaluations. This practice can lead to delays in care and missed opportunities to identify serious conditions. Decisions about referrals should be informed by a thorough understanding of the patient’s symptoms, which often requires face-to-face interaction. Without this, patients are left vulnerable to worsening conditions and unnecessary suffering.

Personal Story
My journey through the healthcare system illustrates the urgent need for enforceable timelines and accountability in diagnostic care.
It began with difficulty swallowing that escalated into frequent choking episodes during meals. Over two years, I saw multiple specialists—primary care physicians, ENT doctors, counselors, and allergists. Despite severe symptoms, my concerns were dismissed as anxiety or deemed insignificant. This cycle of medical gaslighting left me undiagnosed and untreated, resulting in 35 pounds of weight loss, debilitating fatigue, and muscle weakness. Only after years of persistent advocacy did I discover I had absent esophageal contractility—a rare condition requiring specialized care to prevent further complications.
More recently, I developed another rare and alarming symptom: head bobbing synchronized with my pulse, accompanied by head pressure, extreme fatigue, and visible pulsations. Despite the potential seriousness, I faced a six-month wait for referrals and diagnostic tests, each step delayed by a fragmented system lacking urgency and clear protocols. These delays not only worsened my physical condition but eroded my trust in the healthcare system.
These experiences highlight how vague diagnoses and delayed access to tests and specialists can lead to profound physical, emotional, and financial harm. Without enforceable timelines and protocols prioritizing the exclusion of dangerous conditions, countless patients will continue to face unnecessary suffering.

How This Impacts Patients

1. Lack of Accountability:
Without clear timelines, providers and insurers may not feel pressured to prioritize faster care, especially for non-urgent conditions. Patients often feel dismissed or invalidated when told their care is “timely,” even as months stretch on without answers.
2. Delayed Diagnosis and Treatment:
Ambiguity around "timely" care can lead to harmful delays, especially for conditions requiring early intervention. When physicians fail to prioritize ruling out serious or life-threatening conditions, patients are left vulnerable to worsening symptoms or irreversible harm.
3. Unequal Power Dynamic:
Patients have little recourse to contest delays because “timely” is not legally defined. This lack of clarity creates an unequal power dynamic between patients, providers, and insurers.
4. Delayed Care Due to Denied Referrals:
Imagine seeking help for severe symptoms and being told your referral to a specialist was denied—without the provider ever seeing you in person. This has been my reality. Despite alarming symptoms like head bobbing and visible pulsations, my referral was delayed because a provider deemed it unnecessary without fully understanding my condition. This lack of accountability delayed critical diagnostic testing and worsened my condition. Enforcing in-person evaluations would ensure that patients are treated with the urgency and care they deserve.

Proposed Measures
We propose the following solutions to address these systemic issues:

Establish Specific Timelines:
Specialist Appointments: Non-urgent cases within 30 days; urgent referrals within 15 days.
Diagnostic Testing: Non-urgent tests within 30 days; 7 days for cases where life-threatening conditions cannot be ruled out.
Prioritize Ruling Out Life-Threatening Conditions:
Require providers to follow evidence-based protocols to exclude serious conditions before assigning vague or non-specific diagnoses.
Allocate Resources to Underserved Areas:
•Expand funding for telehealth services and mobile diagnostic units.
•Incentivize providers to work in shortage areas through grants and loan forgiveness.
Hold Providers Accountable for Vague Diagnoses:
•Implement guidelines ensuring that vague diagnoses are paired with detailed plans for follow-up testing and evaluation.
•Require providers to document their rationale for ruling out dangerous conditions.
Mandate In-Person Evaluations for Referral Decisions:
•Require healthcare providers to evaluate patients in person before denying specialist referrals, ensuring decisions are based on comprehensive clinical assessments rather than incomplete information.
•Implement oversight measures to track and address instances of unjustified referral denials.
