Demand due process for unlawful newborn seizure by OKDHS in Norman, OK

The Issue

 

 

Imagine the joy of welcoming a newborn into the world, only to have your perfect baby ripped from your arms within hours of birth, with no written judges order and no evidence, your husband trespassed  from the hospital by OKDHS unjustly for simply asking why....leaving you alone to recover from surgery and multiple blood transfusions and no emotional support during and after the heinous, traumatizing seizure of your newborn child. 

 

Then, immediately denied family placement and your child is instead put directly into a foster home with strangers....and all this due to a false toxicology report provided to OKDHS by the hospital after I filed a grievance against them for neglect and refusal to provide care regarding a potentially life threatening pregnancy complication they ignored, A heartless effort to discredit me and escape a pending lawsuit. 

This is my family's reality in Norman, Oklahoma. My newborn baby girl was taken from us by OKDHS (Oklahoma Department of Human Services) within hours after her birth, with no substantial evidence or indication of imminent danger—a gross violation of our rights as parents. 

The heartache and helplessness we feel are immeasurable. Despite have medical records that prove the test was falsified, OKDHS still has our baby and no one will listen.

In our case, six weeks have passed and we have yet to be permitted and a opportunity to present any evidence of our own to challenge the baseless claims held against us. This refusal to demand that OKDHS provide actual evidence of their accusations, and prove immenant danger to validate their emergency custody order, transcends basic legal rights and due process. 

This is not just about my family—it's about ensuring that no family in Cleveland County, or anywhere else has to experience such an unjust procedure.

There are significant consequences accompanied by the unwarranted removal of a child, and we have only been permitted 2 hours with our newborn daughter in the nearly 40 days since she was unlawfully taken by OKDHS in the middle of the night at the hospital. The trauma inflicted upon the child and the family can have lasting effects, disrupting the family’s emotional stability and the child’s developmental environment. When legal processes are disregarded, it creates a precedent for state abuse, undermining the community's trust in judicial systems.

Families deserve to be heard, and their rights protected. We cannot let governmental agencies act with impunity, without oversight, or accountability. We demand that the Oklahoma judicial system administers justice fairly by providing due process and examining all evidence fairly BEFORE separating families.

We urge the Oklahoma judiciary to:
1. Ensure that parents are allowed to present evidence in hearings regarding the custody of their children.
2. Require OKDHS to provide conclusive proof of imminent danger before any removal of a child occurs.
3. Implement transparent procedures to protect families from wrongful intervention. No evidence, no custody. Period. 
4. There must be oversight to correct DHS and the Judge's gross abuse of authority and bias in our state.
