The Issue

On Monday morning in Biddeford, Maine, an Immigration and Customs Enforcement (ICE) agent shot and killed Joan Sebastian Guerrero — a 26-year-old Colombian man who was authorized to work in the United States. He was not the person ICE was looking for.

Hours after the shooting, the Department of Homeland Security (DHS) confirmed to Senator Angus King that Guerrero was not the target of any arrest warrant. Yet he is dead, leaving behind a wife and a young daughter who watched him die in the street.

The officers involved wore no body cameras. The accounts from federal officials changed within hours. And this is the second time in two weeks that ICE has fatally shot someone who was not the intended target of an enforcement operation — a Mexican worker named Lorenzo Salgado Araujo was killed in Houston on July 7 under nearly identical circumstances.

Maine Governor Janet Mills called the Biddeford shooting "reckless and haphazard." Senators Angus King and Susan Collins have demanded answers. Attorney General Aaron Frey confirmed the officer is on leave pending investigation. But a review conducted by the same department that oversees ICE is not enough.

An independent investigation — one with the authority to examine not just this shooting, but the pattern of enforcement operations that keep ending in the deaths of people who were never the target — is the only path to real accountability.

Joan Sebastian Guerrero had a family. He had a life. He had legal authorization to be here. His daughter will never see her father again.
