Demand action on discharge application in Cheating and Forgery Case- Justice for Ashok
The Issue
In 2019, a grave injustice struck when perpetrators forged property documents to cheat and deceive, leading to immense personal and emotional distress for me. Two of the three accused individuals have been rightfully arrested, yet one remains elusive, hiding under the protection of a Look Out Circular (LOC).
The third defendant has put a Petition in Mumbai Highcourt to quash/ Set Aside the LOC which is pending in Highcourt.
Despite this, a chargesheet has been filed, and the charges against the first defendant have already been framed, marking a significant step in this battle for justice.
However, my fight takes an exasperating turn with the second accused, who continues a pattern of evasion under the guise of legal procedures. This individual has persistently sought to evade accountability by filing a discharge application since 2019, a move which the public prosecutor himself acknowledges lacks merit, asserting that a prima facie case is indeed established against him.
Despite overwhelming evidence, the 9th Bandra Court frustratingly continues to grant this accused exemptions, seeming to sidestep taking any definitive action on the discharge application and merely offering new dates. This cyclical deferral, not only prolongs the legal process but magnifies the distress and uncertainty faced by victims like myself who yearn for closure and justice.
This situation is compounded by the fact that, despite repeated opposition to the unwarranted exemptions, and even after the High Court of Mumbai issued an Injunction Order against the defendant, these delays persist unabated. The underhanded attempts by the second and third accused to quash the FIR in both the High Court and the Supreme Court of India failed, yet the battle rages on as their lawyer actively challenges the issued warrants.
Each court appearance, every wrenching wait for a sign of progress, continues to wear on me mentally and emotionally. Yet, I remain hopeful that justice can prevail with the support of concerned individuals and authorities who understand the importance of integrity and justice in our legal system.
I urge the relevant legal authorities to step forward and expedite action on the discharge application of the second accused in this forgery and cheating case.
