Demand action against the smokable hemp ban

The Issue

An Open Letter to Governor Greg Abbott

Governor Abbott, 

We urge you to take action regarding the smokable hemp ban that went into effect March 31, 2026. While we recognize and support reasonable regulations that protect public health, like age restrictions and child-resistant packaging, the harsh restrictions on smokable hemp products and dramatic increases in licensing fees go too far. These changes threaten small businesses, limit access for vulnerable Texans, and undermine an industry that has operated legally since Texas’ 2019 hemp law.


First, this ban will have devastating economic consequences for Texas small businesses. Hemp retailers across the state report that smokable products make up over half their inventory. In addition to eliminating these products, raising licensing fees for manufacturers and retailers by the thousands places an unsustainable burden on entrepreneurs who invested in this industry legally, and in good faith. We’re already seeing the damage it’s done to small businesses as many shops have had to lay off their employees or prepare to close their businesses entirely. 


Second, this ban hurts consumers who rely on hemp products for their health and well-being. From patients with epilepsy to PTSD, hemp-derived products have been seen to improve the quality of life. Veterans and others coping with chronic pain, anxiety, and depression often turn to hemp as a safer and more affordable alternative to prescription medications. Removing smokable hemp products restricts consumer choice and disproportionately impacts those with few alternatives.


Third, this policy is clearly an example of regulatory overreach. It creates uncertainty for the future of the hemp industry, especially for the 8,000 registered hemp retailers who fear this may lead to bans against consumable hemp products like gummies, too. This policy risks destroying a $5 billion industry and jeopardizing the livelihoods of thousands of Texans.


Texans support sensible regulations like enforcing age limits, proper labeling, and child-proof packaging. These measures can coexist with a thriving hemp market, and it’s up to lawmakers and leaders like you to protect those who will be harmed by revisiting these rules, lifting the ban on smokable hemp, and reducing licensing fees to reasonable levels so businesses are not decimated. 


For these reasons, the undersigned residents of Texas respectfully call upon you to take action to protect our right to access legal smokable hemp products, to support the small businesses and farmers who sustain our communities, and to ensure that Texas remains a place where responsible regulation, not overreach, guides public policy.
