Demand Accountability for False Positive Drug Screens Resulting in Unjust Child Removal

This petition is born out of a personal tragedy. A mother in Tampa, FL was unjustly separated from her newborn baby due to a false positive drug screen result. After an emergency C-section at the height of the COVID-19 pandemic, she was subjected to a urine test that wrongly indicated amphetamine use. Despite the first test being negative and her doctor noting it as a false positive due to medication, law enforcement and Department of Children and Families (DCF) were called. Ignoring the doctor's notes, they removed her children from her care.

This incident led to further distress when she was arrested and put on an ankle monitor to restrict contact with her children. She eventually ended up in rehab for 18 months without any evidence of substance abuse - all because of one faulty drug screen.

Unfortunately, this is not an isolated case. The National Institute on Drug Abuse states that while drug testing can be useful for identifying substance abuse among parents, these tests are not infallible and can lead to false positives due to various factors such as certain medications or medical conditions.

We demand that DCF and law enforcement agencies be held accountable for their actions based on inaccurate drug screens results. We call upon them to review their policies regarding child removals related to alleged substance abuse cases ensuring they are fair, justifiable, and based on solid evidence rather than potentially flawed tests.
