Demand a Re-Trial for Mackenzie Shirilla: End the Miscarriage of Justice

The Issue

Why this is important:

We are petitioning the Supreme Court of Ohio, the Office of the Ohio Public Defender, and the Governor’s Warrant and Clemency Board to demand an immediate re-trial for Mackenzie Shirilla.

While the loss of life in the July 2022 Strongsville crash is an absolute tragedy that we deeply acknowledge, the decision to prosecute a catastrophic vehicle accident as purposeful, premeditated murder sets a dangerous legal precedent. Allowing a conviction to stand based on a manufactured courtroom narrative—while ignoring physical engineering data, wreckage photos, and medical realities—sets a precedent that threatens the safety and liberty of every single motorist in Ohio. If the state can turn a sudden medical blackout into a life sentence, no driver is safe.

The Forensic and Scientific Realities:

The S-Curve Misrepresentation: The prosecution’s theory relied on the claim that Mackenzie executed a calculated, straight shot toward the building. However, Progress Drive is a winding S-curve. To navigate this layout at 100 miles per hour, a conscious driver would have to continuously steer left and right to stay on the pavement. Mackenzie did not.

Evidence of a Frantic Cockpit Struggle:

The vehicle’s black box and scene photographs completely refute the state's narrative of a controlled, intentional execution. At one-point-seven-five seconds before impact, the steering wheel registers an abrupt, positive nine-degree pull to the left at the exact same split-second the transmission row breaks out of "Undetermined" mode and registers Sequential Gear Five. A half-second later, the car is jammed into Neutral.

The Passenger Intervention:

This erratic sequence matches the exact physical recovery positions at the scene. Rear passenger Davion Flanagan was not found in the backseat; he was found face-up across a fully reclined front passenger seat with his head in Dominic Russo's lap. The physical data and wreckage show Davion lunged forward over the left side of Mackenzie's headrest to grab the wheel and pull it left after she went rigid, slamming his body into the center console and knocking the shifter into Neutral.

The 88 MPH Speed Drop:

Because the vehicle was forced into Neutral mid-struggle and the tires were violently sliding sideways, the black box clocks the car dropping from one hundred miles per hour down to ninety-three miles per hour right before impact. A conscious driver flooring an accelerator pedal to maximize a crash does not experience a significant drop in speed before hitting a wall. It slowed down because the vehicle was completely out of control.

Constitutional Trial Deficiencies & The Leap Year Failure:

Under the Sixth Amendment, every citizen is guaranteed the right to effective legal representation and an impartial trial. Mackenzie’s original defense team completely failed her. They failed to call independent neurologists or cardiologists to contextualize her medical history of Postural Orthostatic Tachycardia Syndrome (POTS), leaving the court to dangerously misinterpret a medical emergency as criminal intent.

Worse, her former counsel completely failed to calculate the 2024 leap year, missing a strict jurisdictional deadline by just 24 hours and allowing the lower courts to dismiss her post-conviction challenges on a minor calendar technicality without ever looking at the new medical evidence.

Our Objective:

This crash was a tragic, unavoidable medical crisis followed by a frantic struggle for survival—not a premeditated crime. We demand an immediate re-trial. The State of Ohio must protect its citizens and ensure that automotive telemetry data cannot be weaponized by prosecutors as the sole proof of psychological intent without independent, third-party forensic and medical corroboration.
