Cora, Dawson and Callan Clancy deserve the most complete and reliable investigation the Commonwealth of Massachusetts is capable of conducting.

Lindsay Clancy’s first trial ended in a mistrial. Before prosecutors ask another jury to decide this case, the Commonwealth should do more than simply present the same investigation again.

Public testimony raised serious questions about the timeline, digital evidence, physical evidence and the extent to which the Commonwealth’s account was independently corroborated. The evidence presented at trial did not establish whether all reasonably available phone, vehicle, Wi-Fi, location and account data were obtained and fully analyzed; when each child was last independently known to be alive; or whether investigators tested the physical and medical evidence against reasonable alternative explanations.

Lindsay’s injury timeline is also critical.

Evidence presented at trial established that Lindsay went out of a second-story window, landed headfirst on frozen ground and suffered catastrophic spinal injuries that left her unable to move. Yet the precise time of that fall—and its relationship to the children’s injuries, their medical conditions and activity recorded by devices inside the home—was not clearly established through objective evidence presented at trial.

When did Lindsay become physically incapacitated? What objective evidence establishes when she went out the window? What evidence independently places everything attributed to her before that fall?

These are not peripheral questions. Lindsay’s injuries created a critical point in the timeline after which she could not physically have committed the acts alleged against her. Establishing when that point occurred—and placing the other events before or after it—is fundamental to proving the Commonwealth’s timeline.

This petition does not declare Lindsay Clancy innocent. It does not accuse Patrick Clancy—or anyone else—of committing a crime. None of us outside the investigation knows exactly what happened inside that home.

That uncertainty is precisely why further investigation is necessary.

If additional investigation confirms the Commonwealth’s theory, it will strengthen the integrity of any retrial. If the evidence points somewhere unexpected, the Commonwealth—and the public—need to know that too.

Before retrying Lindsay Clancy, conduct a genuine supplemental investigation, independently reconstruct the complete timeline—including Lindsay’s fall and resulting incapacitation—preserve and examine all reasonably available evidence, and resolve every material question that can still be answered.
