Defend Real Estate Professionals Against Corrupt Lawsuits: Stand with Us
The Issue
An Open Letter to the American People Regarding the Lawsuits and Settlements Without Litigation Against the National Association of Realtors (NAR), Associations, MLS Organizations by the DOJ, and the Conflict of Interest in the Sitzer/Burnett Case.
“Our Constitution was made only for a moral and religious people. It is wholly inadequate to the government of any other.”
–John Adams
In the course of human events, it becomes necessary to speak out against injustice, to stand up against corruption, and to hold accountable those who misuse their power. We find ourselves at such a critical juncture in our nation's history. Our institutions, designed to uphold justice and protect the rights of all citizens, have been compromised by those driven by greed and self-interest. The recent lawsuits against the National Association of Realtors, Associations and The MLS Organizations by greedy lawyers, the Department of Justice (DOJ), and others are glaring examples of this corruption.
Good Real Estate Professionals have been long been a beacon of professionalism, integrity, and advocacy for the American dream of homeownership. Yet, it now faces corrupt and baseless lawsuits, orchestrated by those who seek to undermine the very principles upon which this nation was founded. These lawsuits are not just an attack on the real estate industry, but an attack on the rule of law, on the rights of property owners, and on the economic stability of our communities.
Conflict of Interest in the Sitzer/Burnett Case
One of the most troubling aspects of this legal assault is the conflict of interest embedded in the Sitzer/Burnett case, While claiming to represent the interests of consumers, the firm behind the lawsuit has financial incentives that raise serious ethical concerns. Specifically, one of the key players in the lawsuit has opened a price fixing flat-fee real estate brokerage/referral service called Landian —a direct competitor to the traditional negotiated commission-based model they are attacking in court.
This conflict of interest undermines the credibility of the lawsuit and calls into question the true motives behind the legal action. Rather than advocating for consumers, it appears that the lawsuit may be an attempt to dismantle the existing real estate framework to pave the way for a new business model that benefits the very individuals behind the legal challenge. This raises serious ethical concerns and calls into question the integrity of the entire legal process.
The conflict of interest in the Sitzer/Burnett case should be a red flag for all who value fairness and justice. It is a reminder that not all who claim to be fighting for the public good are doing so with pure intentions. The American people deserve better than a legal system that can be manipulated for personal gain.
The Broader Implications
The antitrust cases are part of a broader movement challenging traditional real estate practices. However, these cases, particularly when tainted by conflicts of interest, threaten to destabilize the real estate industry and harm consumers in the process. If these legal challenges succeed, they could lead to lower commissions for real estate agents, but at what cost? The disruption could undermine the quality of service, reduce competition in the long run, and make it harder for consumers to afford and navigate the complex process of buying or selling a home.
We, the undersigned, stand in firm opposition to this lawsuit and the conflicts of interest that taint it. We believe it is rooted in avarice and political expediency rather than in any genuine concern for justice or the American people. The Department of Justice, once a stalwart defender of the Constitution and the rights of citizens, has allowed itself to be co-opted by those who would use it as a tool for their own gain. This is a betrayal of the public trust and a violation of the oaths taken by those who serve within its ranks.
Our Call to Action
We call upon the American people to stand with us in defense of the real estate industry and the principles it upholds. We must demand accountability from those who seek to pervert the justice system for their own ends. We must insist that the DOJ return to its true mission of protecting the rights of all citizens, rather than serving the interests of a select few. And we must expose the conflicts of interest that undermine the integrity of the legal process.
In the Declaration of Independence, our founding fathers sought separation from tyranny. We seek no separation, but rather a restoration of the rule of law and the principles of justice. We pledge to do everything in our power, through lawful means, to hold accountable those responsible for this corrupt lawsuit. We will not rest until justice is served and the integrity of our institutions is restored.
Our nation was built on the foundations of liberty, justice, and the rule of law. We refuse to allow those foundations to be eroded by corruption and greed. We will fight to ensure that future generations inherit a nation that is as strong, just, and free as the one our forefathers envisioned.
May our efforts serve as a testament to our commitment to these principles, and may we, with God’s guidance, restore faith in our institutions and ensure the continued prosperity of our great nation.
Sincerely,
Philip Simonetta
