The image below is a statement given by Chief of Police, Jim Blocker. He addressed why the Police Department did not test Adam Yancer for alcohol or any controlled substance after he shot Zay twice in the chest, inside a crowded bar in which the Police Department was already on scene. The text below, is an excerpt from The Michigan Firearms Act 362 of 1927 and a comparison to the statement given by the Chief of Police.

The statement starts off with him saying that "At the time of the interview, there was no sign that Yancer was under the influence of alcohol." Well, that's funny because the language as written in the legislation says," is under the influence of alcoholic liquor or a controlled substance or while having a bodily alcohol content prohibited under this section." So, you decided against testing because you didn't smell alcohol but disregarded the controlled substance aspect, despite an unarmed man being shot in the chest by a security guard who is personal friends with the owners of the bar? Since when is alcohol only present when you smell it or there are indicators? The text specially list's out in detail the penalties for different BAC's as a result of chemical test, how is it that an external examination can provide the BAC?

Chief Blocker then proceeds to say, "No smell of alcohol, no observations, witness statements or indications - they didn't exist, nor was a PVT (psychomotor vigilance test) utilized, nor was a search warrant able to be obtained," WHY WOULD YOU NEED TO OBTAIN A SEARCH WARRANT IF HE HAS GIVEN IMPLIED CONSECT BY ACCEPTING A CCW PERMIT?! So, did they request one and he refused? What observations did they take of him to determine that he wasn't intoxicated if no PVT test was done? They just looked at him and decided he was fine? This must be the new protocol being rolled out by BCPD, kill somebody with a registered firearm but if you look fine to us then we don't need to test you. This sound like the same sloppy logic in which BCPD decided to wait until "later in the day" to even ATTEMPT to survey the crime scene where Eniyah was shot. Funny how there are all these missteps when people of Color are being gunned down in Battle Creek; no chemical testing, no one can show up to crime scenes on time, officers recording family members of victims, BCPD can rarely locate any evidence when these murders occur, what's really going on?
