Legal ramifications of a dog attacking a human

The issue

On Tuesday the 4th August 2020 , I took my Whippet , Bradley for a walk to Sydney Park. Upon entering I noticed a woman with her toddler and an American Staffordshire Bull terrier the dog was off leash behind her in the children's playground . I continued on and about 20 to 30 metres away,  Bradley relieved himself and suddenly the American Staffy came over unsupervised. He initially wagged his tail and when I said to Bradley "Let's go" the Staffy went crazy and was attacking my dog who was screaming with fear. I tried to kick it and get him away screaming and screaming but he was relentless . The owner was nowhere to be seen. I fell over and upon getting up managed to grab the back of his collar to get him off my dog.  At this point the dog attacked me. I sawt's jaw around my arm and threw me to the ground. It was at this point the owner finally realised what was happening and came over saying "hes never done this before"...her dog did not stop . It wanted to kill my dog and she tried to restrain it but it kept breaking free from her wanting to maul my dog.  My dog miraculously came out with a tiny scratch but I did not. I called the police who came to hospital to take my statement  but was informed it was out of their hands and they would forward to Sydney city council. Long story short I ended up in hospital for 6 days. My child and My dogs had to be sent away to be cared for. My arm will be disfigured for the rest of my life . I help my father care for my elderly mother who is bedridden with dementia now I can't help him until this heals . I cant cook, and caring for my dogs and daughter is not easy with 1 arm out of action not to mention the trauma my dog has and is suffering now and the trauma Im left to deal with for myself as im finding i am petrified when a dog approaches me now.  This woman will receive a fine of which the proceeds will be going to Sydney council, who advised me that the dog gets 3 chances , 3 chances to harm another person, heaven forbid if its next victim is a child. First chance the owner receives a hefty fine. Second chance, the dog is deemed a dangerous dog and must be on lead and muzzled to leave the house. Third chance the dog is euthanased.  The dog has 2 more opportunities to hurt or possibly kill someone or something . Imagine if this was your child. Why does the dog get so many chances when clearly it is a dangerous dog after the first attack. The owner had the dog in a children's playground , which is prohibited . "This could have been a child." In my time recovering in hospital I was told that its happening more and more. Even the patient next to me had been attacked by a dog.

Certain breeds of dog may be considered “dangerous” or “menacing”. In NSW, restrictions apply to breeds including Pitbull terriers, Japanese tosas and Argentinian fighting dogs. Owners of these breeds of dogs should take extra caution. The dog in my case was roaming around free unbeknownst to it's owner.

Something needs to be changed here and I'm reaching out to amend this Law!
