El triunfo de la Revolución Cubana de 1959, condicionó el alineamiento de Cuba al Campo Socialista, el cual tenía una concepción monista del estado y consideraba el derecho un instrumento -y por tanto sin valores propios- del poder político.

Extrapolada de su espacio vital natural, el hemisferio occidental, Cuba se convirtió en un satélite de las aspiraciones geopolíticas de la Unión Soviética, cada vez más alejada de la concepción del estado y del derecho de Ignacio Agramonte y José Martí, Padres Fundadores de la conciencia nacional.

En la actualidad Cuba vive la peor crisis de su historia, sin capacidad para satisfacer las necesidades mínima de una población que asume con resignación vivir en un ESTADO FALLIDO que pone el peligro su existencia y Las Américas y el mundo .

POR TANTO, nosotros, ciudadanos cubanos, amparados en nuestros deberes y derecho a una “Patria con todos y para el bien de todos”, donde la “Ley primera de la República sea el culto de los cubanos a la dignidad plena del hombre”, como la soñará El Apóstol de nuestra independencia, convocamos al siguiente

 PACTO SOCIAL

Artículo I. El Ciudadano es el Soberano y, en consecuencia, la primera y última fuente de poder.

Artículo II. Son inviolables los derechos humanos de la persona humana.

Artículo III. El fin del derecho debe ser la justicia.

Artículo IV. Poderes independientes delegados al Estado, como pesos y contrapesos institucionales, a fin de garantizar el equilibrio social.

Conscientes de que un pacto es la ley entre las partes,

The triumph of the Cuban Revolution of 1959 conditioned Cuba’s alignment with the Socialist Bloc, which embraced a monistic conception of the State and regarded law as a mere instrument —and therefore devoid of intrinsic values— of political power.

Removed from its natural vital space, the Western Hemisphere, Cuba became a satellite of the geopolitical aspirations of the Soviet Union, increasingly distancing itself from the conception of the State and of law embodied by Ignacio Agramonte and José Martí, Founding Fathers of the national conscience.

At present, Cuba is experiencing the worst crisis in its history, lacking the capacity to satisfy the most basic needs of its population, which resigns itself to living under a FAILED STATE that endangers its own existence, as well as that of the Americas and the world.

THEREFORE, we, Cuban citizens, protected by our duties and rights to a “Homeland with all and for the good of all,” where “the first law of the Republic shall be the Cuban people’s devotion to the full dignity of man,” as dreamed of by the Apostle of our independence, hereby convene the following

SOCIAL PACT

Article I. The Citizen is the Sovereign and, consequently, the first and ultimate source of power.

Article II. The human rights of the human person are inviolable.

Article III. The ultimate purpose of law shall be justice.

Article IV. Independent powers are delegated to the State, as institutional checks and balances, in order to guarantee social equilibrium.

Aware that a pact constitutes the law between the parties,
