The issue
thousands of apartment owners are facing special levy for combustible cladding replacement around Australia
Because Councils force to replace combustible cladding on time but builders said NO not our liability then because of pressure from councils, strata (owner corporations) have to raise money from apartment owners to do the job, telling owners they may probably win the case against builder (in around 20 months) , then getting money back from builder, and repay back to owners after 20 months, but who knows what will happen the future ? who can guarantee money back, and how much will be back? 3.95 or 1 dollars?(some special levy is 12000aud)
So owners don't "lend money "out for replacement of cladding, owners didn't approve building , owners didn't install cladding, owners should not pay even 1 dollars out.It is unreasonable. Councils or builders should be liable .
Councils approved the building for apartments, so they should be responsible for "finding cladding is combustible" too late , or they change their mind(when building finished they said cladding was ok), so councils should loose time frame for cladding replacement ,whenever course case finished, builders found liable for cladding, then start cladding replacement, whenever money is ready , then start cladding replacement, but owners should never be liable for get money ready for that, if builders not found liable for combustible cladding, then councils should get money ready to replace cladding,because they approved buildings.
one owner from park life of clemton park village,campsie,N S W heard recently around 480 building across N S W with combustible cladding need to replaced ,around 30 buildings affected in canterbury -bankstown area, their strata -"strata plus" told him there is now 120 days left for CBCITY council's time frame .otherwise councils will issue penalties for building ,may result in insurers refusing to cover building, strata plus is suing builder Parkview in court about the combustible cladding, but Parkview said NO and court case is still going, owners received 12000AUD special levy bill from strata plus ,plenty owners unite and refuse to pay this unfair special levy
strata plus said court case will probably win(around 2 years later) then they can repay money back to owners, but who knows, owners should not pay this if they are not liable for cladding.Once owner paid money, all of about money refund is uncertainty.
In another village in Sydney, The Garden's in Putney Hill,,it took 18 months for the owners to win the legal case against builder, they didn't even receive any special levy bills, this is their news link,
