To Whom It May Concern:

I just discovered I have a Letter from North Carolina Court of Appeals that my Newly Discovered Evidence has to go back to Superior Court. I realize you guys have to honor that by law. It like a higher Court giving you a Writ of Mandamus. 

 

Also, I asked Judge Mary Ann Tally several times to recuse herself in Court for clearly being prejudice and bias against me in the courts and she refused. Judge Mary Ann Tally by law should have responded appropriately to my oral request or Motion to Recuse Trial Judge, but she refused. At the time I did not know, but she knew that Town of Cary, Officer Kevin Bern's relative FTCC Board of Trustee, Dr. Linwood Powell did business with her son, Trustee of FTCC, Attorney Lockett Tally at FTCC. See all together in picture as Judge Tally swore her son in. Officer Kevin Bern's mother is Barbara Ann Powell. Also, Mary Ann Tally is related to Town of Cary Officer Justin Anthony Mallard, which was a Subpoenaed witness whom never answered the Court Order. Related to him through Ray Millard, which is on her late husband John C. Tally's obituary. This explains why she trying to impeach witness and you all had a black officer come into court posing as him, a False Witness. I had the Right to a Fair and Impartial Judge.

Town of Cary in the Trial on January 29, 2020 used a recording from their patrol car, which they did not have my permission to record. Officer Branch, as Law Enforcement or other State Agency approached me in custody to obtain statements and discussed unrelated other purposes without reading me my Rights as well. On the previous video and audio Town of Cary brought and played before court. They did not give me 15 days notice before trial of its intent to introduce the evidence at trial and provide a copy of the evidence for me. In the Audio video prior to they muted their mics while they laughed and talked and Officer Kevin Bern called Amy Brooke Russell, Amanda instead of the name they used of paperwork for legal purposes. They also used verbal judo to stage everything for court. Plus, Sgt Edwards did an previous interview with me prior to court proceeding, saying she was only trying to investigate my previous misconduct complaint on Officer Kevin Bern.

I requested from Judge Mary Ann Tally several times for a continuance in order to hire an Attorney and the prepare for the new evidence they brought as a surprise and showed to jury in Court. She refused me. Which was my Right to a Lawyer and Right to know who my accusers are and the nature of the charges and evidence against me.

Courts did not record race of Jury. The Jury consisted on 98% white, from Cary and Apex area, mostly Government employees, Employees and relatives of the opposing party. Town of Cary Attorney Lori, Sherry Archibald, employee  of Weil Family Paramount Theatre, their relative Neal Dennis, Attorney Christopher Godwin,  Ricky Narron, Attorney Geoff Hulse partner of opposition Attorney Glen A. Barfield and many others who used fictious names on Jury. Did not mention everything which should have been explained and mentioned to court and Jury in Jury Instructions.

Steven Schroller, from Pepperdine Law and a relative and or business partner of Town of Cary Chief Anthony Godwin, which many Judges sit on boards at, reached out to me from said Trident Insurance, Argo Group but was also partners with Hatch, Little& Bunn LLP whom represent opposing parties WAJ Management, Town of Cary and Weil Family. Also, contacted by Larry Hall with James C. Green, partner of WAJ Management. Said Court Reporter and NC Clerk of Court, Tammy Lee Johnson aka Tammy Allen is relative of opposing party. Have businesses and on Deed work together, Clubs and Associations.

Charged twice on Worksheet for Simple Assault and recorded on NC DOC record as Simple Assault and Affray, which I was never in Court nor convicted about an array not even mentioned. Error of sentencing on Worksheet and counted a traffic violation and misdemeanor alcohol charge in which I was already 21 when I purchased, which was of age. False Misleading Information was put on my Civil and Criminal record to cause me more intentional emotional distress and to Retaliate against me for redressing Government with grievances.

Town of Cary Town Manager Russ Overton, Town of Cary Chief Anthony Godwin, Office Kevin Bern, Office Brian Austin, Judge G. Bryan Collins Jr, Judge Mary Ann Tally, Officers Carter, Spell, Bernhardt, Cavalear all named as Officers called on scene on August 22, 2018 and many involved has businesses Hatch Little & Bunn LLP oversee, make judgement for and partner with. Same personal and financial interest. They all handled my case, were involved and conspired to deprive me of my Rights. One of the Attorneys involved whom I filed a misconduct complaint on at the NC Bar, Attorney Gregory C. Malhiot, Professor from NC Central and partner of WAJ Management's former student, Jaren Kelly came in as Wake County Assistant DA whom prosecuted my case. Whom did not argue according to legal standards and admitted to knowing Officer Bern prior to my case after Court. How ironic! Attorney Stephanie Jordan whom was Public Defender over my case in Mecklenburg County years ago, her family are in business with Chief Godwin's family and Officer Brian Austin's wife, April Tew, SOSID# 0059753. Constance Bunn and. Joyce Johnson are all employees of opposing party, Weil Enterprises and relatives of Hatch Little & Bunn and Tammy Lee Johnson and relatives of members of WAJ Management. Judge G. Bryan Collins Jr, whom presided over my case on June 27, 2019, finally had sense enough to Recuse himself on August 19, 2019, after orally requested several times and written by Motion. Having several relatives employed by Town of Cary, NC, such as Ken Collins, Lyman Collins and many more. Including his late father, George Collins Sr, businesses being ran by Hatch, Little& Bunn LLP SOSID# 0007351, #0303692, #0001959 and more. Just too much to list here!

You all know Town of Cary Officer Aided and Abetted Amy Brooke Russell in a crime. Office Kevin Bern created a probable cause and lied about me assaulted her when I was the one who was simple assaulted in front of him while he watched and fail to intervene. Then said I was arrested when I put my hand up to grab her hand to keep her from striking me in the face. He along with many others here entrapped and framed me up with Simple Assault charge to help WAJ Management and conspirators retaliate and create an constructive eviction to get my out and punish me for writing prior grievances and Misconduct Complaints and prevent me from Suing them. Town of Cary are know for racial discrimination and violating citizens rights in many court hearings. Also, hindering citizens from suing them when that was there right.

Plus, you all violated my 4th, 5th, 6th, 14th Amendment Rights and Article I Section 19 and 23 of North Carolina, Chapter 90 Notice and Demand, Due Process, Equal Rights, Right to a Fair and Impartial Judge and a Fair Trial in Court. Plus,  to violating NC 15A-1223 Disqualification of Judge, 5th Amendment, 14th Amendment and Canon 3 of the NC Code of Judicial Conduct, Deprivation of Rights Under the Color of Law, Conspiracy Against Rights, Right to Self Defense, Error in Jury Instructions,  Prosecutorial Misconduct, Judicial Misconduct, Law Enforcement Misconduct, Criminal Interference with Fair Housing)

This letter is also serves as an Motion of Assertion of my Rights.Just because I have a Felony on my record from more than twenty years ago, it doesn't give you a right to violate my Rights. I never signed a Plea Deal with the State. I'm sure you do not want the U.S. Congress nor Senate to hear about your intentional wrongdoings. No need for them to come and attempt again to steal evidence out of my car, or do further surveillance abuse etc the Attorney already have everything.

Collins, Judge Mary Ann Tally Judge Patti  teams and their other conspirators keep stalking, harassing and intimidating my child and I and trying to build a case and pin more charges.

We need to get people like mentioned out of positions of power. Thanks for listening to the letter I wrote them and the private matters that are destroying us as Citizens. When we speak truth to power the first thing they do is try to make others not listen to us and put out false information out about us to discredit what were speaking about. All my child and ever wanted was relief from their distress and injury.

But, if I am lying, I am willing to denounce Christianity. I'm just gonna put it all their hidden corrupt tactics they use on their own Citizens in their own Country out there so people can know what's really going on!
