

The National Registry of Exonerations has announced yet another Black man in New York who was exonerated.
During the murder trial, Detective Steven Smith falsely testified that several witnesses saw Austin Babb leave the crime scene on a bicycle.
This statement turned out to be completely false: “I don’t know what the detective is referring to,” the prosecutor said. “[T]here’s only one person...that made an ID,” and he “didn’t see the…shooter fleeing on a bike.”
But amazingly, the defense motion to bar testimony about the identification of Babb was denied.
The court sentenced Babb to a 48-year sentence. Six years later, he was exonerated based on the prosecution's failure to disclose evidence that undermined the credibility of its key witness.
How will detective Steven Smith be disciplined? Why does our criminal justice system allow such travesties to continue?
