One of the "intervenors" in the currently pending litigation with Moorestown Township is Fair Share Housing Center, Inc. That group is the one that has provided a report to the Court demanding between 1500-1600 units of low/moderate income housing to be built in Moorestown over the next 7-8 years. That same group owns/operates (through a related entity that operates low income housing) a low/moderate income housing project in Mt Laurel NJ, which is known as the Ethel Lawrence Homes on Mt Laurel Road. Interestingly, I have seen public records filed with the Superior Court in Burlington County where one of the residents in that rental complex sued Fair Share Housing, as well as Mount Laurel Township, alleging negligence and recklessness in the way they maintained their property. The Plaintiff in that case claims that she sustained serious and permanent injuries as a result of the negligence of Fair Share and the Township even though she has lived in the development for 10 years at a rental rate far lower than the market rate would be in surrounding rental properties. This leads to other questions and concerns as it relates to the plan for a similar type of low income housing that the Moorestown Council is considering for 200 Hartford Road, particularly if the Fair Share Housing group is going to develop and maintain the project. First, why is Fair Share failing to maintain the property in a safe manner for its residents? Second, why is the resident suing the Township in addition to the Fair Share group, is there some claim that the Township still has liability for the low income housing project even 15-16 yeard after it was built? Third, is that what we are facing here in Moorestown if the Council's proposed plan proceeds to build a similar low/moderate income housing project on Hartford Road? That is, residents in the development suing the Township and/or Fair Share (or any other group associated with the project) for negligence if they get injured anywhere on the property? Will that mean even higher taxes for the taxpayers when the insurance premiums for the Township rise to cover this new type of risk?
