Update from last night's Planning & Zoning meeting. P&Z voted 4-3 (tight vote) to recommend the ROO ordinance forward for Council approval. DESPITE major issues, questions, and concerns brought up...they are moving forward.
A few more issues (recent discoveries) -
It was uncovered last night that there WILL be issues for landlords and renters because of the way the legacy clause in the ordinance is written. See provision in the current NCO handbook (9.2)
Example: You are a landlord/property owner. You rent to 4 unrelated individuals at the time the ROO is adopted. You then rent to a family after the ROO is adopted. You would be prohibited from going back to 4 unrelated. You would also lose this ability IF you would go from 4 to 3, even temporarily (3 months or more). This will cause a 'taking' of value from that property owner and reduce available housing for renters.
The Petition Committee that would be formed to push a petition in a neighborhood would NOT have to be comprised of property owners in that neighborhood. So an outside group of individuals could come in and organize, interfering with the rights of the rights of those property owners.
