The Issue

As a parent raising my children in this community, the safety and protection of all children is my utmost priority. Recently, I've discovered a glaring loophole in Pennsylvania's child solicitation law, 18 Pa. C.S. § 6318, which leaves our children vulnerable and local law enforcement unable to fully enforce protections. This is not just an oversight; it's a systemic failure that demands immediate attention and action.

Currently, the language in 18 Pa. C.S. § 6318 does not adequately cover all instances of child solicitation, leaving significant room for offenders to exploit young, innocent victims. Our police officers and district attorneys are committed to safeguarding our communities, but this outdated law ties their hands, making it challenging for them to prosecute cases effectively and deter potential offenders.

Statistics show that in Pennsylvania, child solicitation is a growing concern, with an increasing number of cases going unpunished due to loopholes like this. According to the National Center for Missing and Exploited Children, reports of online enticement have doubled in recent years, emphasizing the urgent need to strengthen legal frameworks.

I implore legislators to close this loophole by amending 18 Pa. C.S. § 6318 to include all forms of child solicitation, regardless of the method or intent. Comprehensive legislation is necessary to cover not only physical but also digital solicitation, ensuring that no predator can slip through cracks in legal wording.

By amending this law, Pennsylvania can set a precedent for other states struggling with similar issues. We must take decisive steps to guarantee that every child is shielded from harm and that those who seek to exploit them face the full consequences of the law.
