Clemency for Daniel Simms: End 19 Years of Injustice and Restore Hope for a Reformed Life

The Issue

Daniel J. Simms has unjustly been in prison since February 2006. Almost nineteen years in February. Daniel was railroaded when he proceeded pro se under the Sovereign/Secured Party theory. A theory which he no longer subscribes to. The Court and Prosecutor knew Daniel's theory would fail yet they still allowed the proceedings to continue. Due to Daniel's immaturity and incompetence, he did not argue the merits of the case whatsoever. This is a violation of Supreme Court precedence stating the Court's duty to establish competency and an unequivocal waiver of counsel. The prosecution and alleged victim failed to testify to how the events stemmed from drug dealing and usage. Which would have perhaps changed their verdict. A clear Brady violation. Moreover, Daniel had zero mitigation evidence presented to the Court. Even though we now know Daniel suffered severe abandonment, abuse, and homelessness as a child leading to him self-medicating with street drugs. No one was murdered. No sexual crimes on Daniel's record. No one was even severely hurt by Daniel. Yet Daniel is slowly being murdered by the State. The entire criminal episode was essentially a drug deal gone bad turned alleged robbery. If Daniel was to serve out his entire sentence he would be released in December 2039 if he survives. Almost thirty-three years! A slow death sentence! Who knows if he will make it out of prison alive? Daniel has got family history of fatal cardiovascular events. Currently, Daniel has high blood pressure problems as well so there is no guarantee he will survive his sentence. Daniel also has innocent family members including his nineteen-year-old son, Dillon Ryan Krug, who has unfairly been denied his father. Daniel is a productive member of society even though he is not in society. As a certified paralegal, Jailhouse Lawyer Member of the National Lawyers Guild, and the National Jailhouse Lawyer's Initiative, Daniel has a passion for fighting for the civil rights of troubled Americans. Daniel has computer programmer/video game designer certification (i.e. HTML, JavaScript, PHP, CSS, and MySql). A certified bookkeeper certification. And completed many self-help certifications. Daniel has written three books, Hopeless in Seattle: A Fosterkid's Manifesto, The Art of Living: Everything You Need to Achieve Success in Life and Business I Learned in Prison, and Defund D.O.C.: Turn All Prisons Into Treatment and Career Centers. In addition, Daniel is a founder and co-host of the National #1 nonpartisan social movement DefundDOC.net podcast/blog. In totality, Daniel has repeatedly demonstrated extraordinary rehabilitation. His unassailable reformation and change of character were refined by his guiding principle to be a "good person." With many years sober Daniel has exhibited true and genuine change. Daniel has obtained an attorney to help petition for Resentencing/Clemency but it would help if he had large community support for his release. Therefore we seek signatures on a Change.org petition so that we can present it to State Officials.
