Clemency and Time Commutation for Jerry Herron
The Issue
On February 23, 2002, 21-year-old Jerry Herron was involved in a tragic event that changed many lives, including resulting in one man losing his life. In the midst of the victim and Jerry’s co-defendant exchanging gunfire, Jerry pulled out his gun in self-defense. When Jerry pulled out his gun, another individual grabbed Jerry’s arm and wrestled for the gun, resulting in the gun discharging twice. To this day, it is uncertain if Jerry’s gun was the weapon responsible for the death of the victim; bullet testing proved to be inconclusive. What is certain is that Jerry never woke up that day with the intent of harming anyone. He does; however, take full responsibility for his actions. He knows how that tragic day greatly affected the victim’s family and his own family. For his involvement in the victim’s death, Jerry was convicted of first-degree murder and sentenced to life in prison.
It has now been over 20 years since that day and Jerry is striving to show the world and the Arkansas Post-Prison Transfer Board that he is mature, rehabilitated, remorseful, and humbly ready for a second chance at life outside of the prison walls. He has become a model inmate, mentoring those new to prison who are trying to make sense of the consequences that arise from poor decisions. He also exemplifies respect for those around him, including those in authority positions. His behavior and attitude are exceptional; he has no major disciplinary infractions, and he is always thinking of ways to better himself, despite the circumstance. Speaking of bettering himself, Jerry has led the way in his own rehabilitation. He has completed numerous rehabilitative courses, stayed physically fit, studies regularly as the law librarian, and maintains a relationship with his fiancée.
In addition to Jerry maturing and readying himself for life in society, there are some injustices in Jerry’s case that make his appeal for clemency even more pertinent. These include the presence of juror misconduct, ineffective assistance of counsel, and the exhaustion of all his appeals.
