FL Homeowners Insurance rates

The Issue

Subject: Urgent Action Needed: High and Increasing Homeowner's Insurance Rates in Florida

Dear Sir,

As concerned Florida homeowners, we are writing to bring your attention to a pressing issue that is affecting families across our state—the exorbitant and escalating rates of homeowner's insurance. We urge you to take immediate action to address this critical matter and provide relief to homeowners who are struggling to afford their insurance premiums.

Over the past few years, many homeowners in Florida have been burdened by the skyrocketing costs of homeowner's insurance. The premium increases have become unsustainable for countless families, leading to financial hardship and uncertainty. This situation is especially concerning given the numerous challenges homeowners already face, from property maintenance to property taxes and mortgage payments.

The unique risks posed by Florida's climate, including hurricanes, tropical storms, and flooding, contribute to the higher insurance costs. While we understand that insurance rates must reflect the associated risks, the current situation has reached a point where many families are being priced out of their homes.

We kindly request that you consider the following actions to address this issue:

1. **Transparency and Accountability:** We urge you to work with insurance companies to enhance transparency in how rates are calculated. Homeowners need a clear understanding of the factors driving premium increases and the justification for these hikes.

2. **Regulation and Oversight:** We ask that you evaluate the current regulatory framework for homeowner's insurance in Florida. Are there areas where additional oversight is needed to ensure that insurance companies are not unfairly inflating rates?

3. **Mitigation and Preparedness Programs:** Implement measures to reduce the risk of damage to homes due to natural disasters. Encouraging homeowners to invest in fortifications and adopting resilient building practices could lower the frequency and severity of claims, which might help in stabilizing insurance rates.

4. **Encourage Competition:** Explore ways to foster increased competition among insurance providers in the state. A more competitive market could potentially lead to more reasonable rates for homeowners.

5. **Assistance Programs:** Consider creating programs to assist low-income and vulnerable homeowners who are struggling to afford their insurance premiums. Providing financial relief or subsidies could make a significant difference for those facing the greatest challenges.

6. **Long-Term Solutions:** In addition to short-term measures, we ask for your commitment to developing long-term strategies that will help Floridians manage insurance costs over the years. This could involve collaborating with experts in risk assessment, climate resilience, and economic modeling.

Our homes are more than just buildings; they are the foundation of our families and communities. The current trajectory of homeowner's insurance rates is not sustainable and threatens the stability and well-being of countless Floridians.

We sincerely appreciate your attention to this matter and your dedication to serving the interests of Florida's homeowners. Your efforts to address the issue of rising insurance rates will have a lasting positive impact on our state.

Thank you for your time and consideration.

Sincerely,

FLORIDA HOMEOWNER

You, as a homeowner or HOA need to get Property Insurance in FL.  How many options do you have?  Would you agree that there is only one choice?  Therefore, many homeowners and HOAs are facing very steep increase in Premiums.  HOAs are creating Special Assessments due to the shortage in their budgets for mandatory insurance coverage.

Other insurance companies are either turned off their "business" in FL or their actuarial departments increased premiums to the point of no affordability.

The fact:

Citizens was created by the Florida Legislature in August 2002 as a not-for-profit, tax-exempt, government entity to provide property insurance to eligible Florida property owners unable to find insurance coverage in the private market.

The call for action:

We as Florida homeowners need more competitive Insurance Providers or we have to call attention of Regulators and Legislators to address Antitrust laws.

Here is a look-back:

The Sherman Antitrust Act is a landmark piece of legislation in the United States aimed at promoting fair competition and preventing monopolistic practices that could harm consumers, competitors, and the economy as a whole. It was enacted in 1890 and remains one of the most important antitrust laws in the country.

The Sherman Antitrust Act consists of two main sections:

1. **Section 1:** This section prohibits contracts, combinations, and conspiracies that restrain trade or commerce among states or with foreign nations. In other words, it targets agreements or collaborations among businesses that seek to stifle competition or manipulate markets.

2. **Section 2:** This section addresses monopolization and attempts to monopolize. It makes it illegal to acquire or maintain a monopoly in any part of trade or commerce. This provision aims to prevent one company from dominating a market to the detriment of competition and consumers.

The Sherman Antitrust Act was a response to the growing power of large corporations and trusts in the late 19th century, which were seen as stifling competition, driving up prices, and limiting consumer choice. It was sponsored by Senator John Sherman and passed with bipartisan support. While the law was initially somewhat vague in its language, subsequent legal interpretations by the courts have helped clarify its scope and application.

Over the years, the Sherman Act has been used by the U.S. government to initiate legal actions against various companies and practices that were deemed anticompetitive. Notable cases include the breakup of Standard Oil in 1911 and the antitrust lawsuit against Microsoft in the late 1990s.

The Sherman Act has paved the way for other important antitrust legislation in the United States, such as the Clayton Antitrust Act of 1914 and the Federal Trade Commission Act of 1914, which further strengthened the government's ability to regulate and prevent anticompetitive behavior.

Enforcement of the Sherman Antitrust Act continues to be a significant tool in promoting competitive markets and preventing unfair business practices that could harm consumers and the economy.
