Received a letter from my local MP just now containing a reply from Alison Saunders, director of public prosecutions for the CPS. As we all know, because of the time of the incident, doli incapax would have applied. Although doli incapax is a potentially rebuttable presumption, that the court have to prove beyond reasonable doubt that the suspect (i.e. my cousin) knew his actions were seriously wrong. The fact that I told the CPS that he said he wouldn’t close the door when he was raping me because it made it easier to for him to hear if someone was coming up the stairs, and that he had received sex education as he was in high school, isn’t enough. Because he denied all allegations when questioned by the police, he’s free and always will be. Heartbroken doesn’t even come close. I have no words for what I’m experiencing right now.
