The Issue
Oregon’s outdoor recreation industry is a critical part of the state’s economy, appeal, and has positively impacted our communities from Ashland to Bend to Pendleton to Astoria. I, like many Oregonians, have dedicated my career to this field. A space that fuels passion, learning, and reconnection to our natural world.
The outdoor recreation industry employs more than 73,000 Oregonians and is responsible for bringing $8.4 billion into the economy every year according to state reports. However, the current state laws regarding liability waivers are crippling our industry. These laws are not only driving operational costs through the roof but also stifling the potential for growth and innovation. Within ski areas and other outdoor recreation companies.
At present, these laws impose overwhelming burdens on recreational businesses by making them excessively liable for accidents and injuries. This has resulted in increased insurance premiums and legal fees, causing many businesses to reconsider offering certain activities. For residents, we have seen prices rise significantly to cover potential legal costs, creating unnecessary barriers to the outdoors.
We are calling for a revision of these liability waivers to offer balanced protection for both the operators and the participants in outdoor recreation.
Other states have successfully navigated these challenges by adopting more business-friendly liability laws, which have resulted in thriving outdoor recreation industries. Not only can Oregon learn from these examples, but by reassessing our existing laws, we can create an environment that supports both safety and economic growth.
We are urging lawmakers to consider the unique needs of the outdoor recreation industry and implement changes that will enable it to thrive.
