The Issue
I want to address a grave reality that painfully affected my life and the life of my family when my brother died in county jail due to systemic negligence. He was ignored, neglected, and then cast aside as a 'with no next of kin found,' leaving him vulnerable without a voice and with no justice granted for the injustice that led to his untimely demise. While battling the aftermath, we are continuously faced with barriers in accessing justice.
Currently, systems and institutions benefit from an array of loopholes that allow them to avoid accountability in cases of systemic homicide by negligence. The legal framework allows these entities to handle evidence under their preferred timelines, delaying or even avoiding crucial investigations that could establish liability. Furthermore, they exploit these loopholes to release inmates from custody although they died or faced injury while locked up, freeing themselves from any obligation towards next of kin, leaving families like mine grasping for answers and closure.
Statistics show a concerning trend: according to a report by The Sentencing Project, there are tens of thousands of reported cases annually within the United States where jail and prison institutions fail to properly notify or handle situations involving inmate fatalities. These systemic oversights are intolerable, and they demand immediate legislative attention.
We need laws that enforce timely and transparent evidence handling procedures to ensure justice is served. Institutions must be held accountable, and a firm legal mandate must exist that requires them to inform next of kin adequately and swiftly. This change will not only honor the memory of those who suffered due to such negligence but will also reform flawed systems for future betterment.

I would like to curate for new legislation called "The Tempest Law" that will set a new standard of practice in terms of how these In Hold Deaths are handled, investigating and remove the in house protections through omission and silencing the directions these cases take that further dismiss and diminish these tragedies that come from Institutions.
