Change Indiana law to mandate blood tests after serious accidents

The Issue

On November 4, 2024, our 16 year old son Mitchell Sterling was tragically killed in a traffic accident by a driver who was distracted and reckless. Despite clear signs that her reaction time was altered, she was never tested for drugs. This glaring oversight has left our family without answers and justice, knowing that critical evidence was never gathered. 

Indiana has mandated only a breathalyzer test to determine if alcohol was a factor in traffic accidents causing fatalities or serious bodily injury. However, there has been no mandatory procedure to test for drug use.  

Shortly after Mitchell's accident, we began our mission to change this outdated law to include blood testing when there is a fatality or serious bodily injury. We have achieved part of our goal with the recent passing of Bill 1207!  Starting July 1st, an officer MUST offer a chemical test specifically including a blood draw to any person believed to operate a motor vehicle involved in a fatality. 

Our achievement is monumental but THERE IS STILL WORK TO BE DONE.  We must add "serious bodily injury" to this new law. Mandatory blood draw for fatality only is not enough.  Mitchell was not pronounced dead for 10 1/2 hours.  By that time, it was too late to get a valid blood test from the offending driver.  Serious bodily injury accident survivors deserve the same investigative protocols.  Lives are altered, sometimes irreparably yet there are no consequences for the offenders.
