Challenge the FMCSA Hours of Service Rules and Regulations for Owner Operators

The Issue

As an owner operator, I find myself in a position where my constitutional rights are being violated by the Federal Motor Carrier Safety Administration (FMCSA) Commercial Driving Rules and Hours of Service Limits and Regulations. These rules, specifically the 14 Hour Driving Limit, 11 Hour Driving Limit, 60/70-Hour Duty Limit, and the 34 Hour Restart regulation are not just restrictive but also unfair. They hinder my ability to function economically and provide for my family.

These regulations were designed with safety in mind; however, they do not take into account the unique situations faced by owner operators like myself. The rigid structure of these rules does not allow for flexibility that is often needed in our line of work. This has resulted in undue stress and economic hardship.

The U.S Constitution protects citizens against any rules or regulations deemed unfair in every aspect and practice. Yet these FMCSA regulations seem to overlook this fundamental right when applied to us - owner operators.

We are calling on lawmakers to review these stringent rules imposed by FMCSA on commercial drivers like us who own our operations. We believe there is a need for more flexible hours-of-service regulations that respect our constitutional rights while still ensuring road safety.
