Cause of Death Discrimination in the Military
The Issue
My sons father SSG KYLE W. LEFLORE SR.
was killed on leave while serving as an active duty soldier on 6 Jan 2018 in Omaha,NE.
Many DOD schools do not allow children of active duty parents who are unable to get housing on post or opt to purchase a home in order to save money, to attend the on post public schools unless they have an exception.
The exceptions vary but one that is included is children of active duty parents who have died.
This petition addresses the issue that if you don’t die a certain way despite your lack of control if someone murders you, your family will not receive a school slot. One that is definitely available but just not to you. It doesn’t matter if the other parent is still serving on active duty status either.
However DOD civilian employees can utilize the on post school system.
The response given by Ft.Bragg DODEA School liaison after asking me to send her his death certificate and casualty report was the following:
“In reviewing the documents you sent, unfortunately the service member’s cause of death does not qualify under the Fallen Soldier Provision authorized in Title 10. At this time enrollment as a Gold Star member cannot be considered.”
After I confirmed that due to the way he died my son can’t attend on post schools, she responded with one word “Correct”.
This petition to change the verbiage of this fickle policy and the way they treat families of ALL fallen soldiers is needed and long over due. More soldiers die here on American soil than fighting a war and the message the DOD is standing behind is “We don’t care after you’re dead”. Furthermore this policy of open school slots not being given to active duty soldiers who are stationed on these installations is mind blowing because without us thousands of civilians wouldn’t have the jobs they have now.
A soldier can serve 18 years honorably, get into a car accident on the way to the grocery store and be deemed a not “good enough” death to secure a school slot for their child yet we are Soldiers 24/7. Imagine this being you.
