Calling on Harris County DA Sean Teare to Investigate Darius Elam's Claims of Innocence

To: Harris County District Attorney Sean Teare and the Conviction Integrity Unit (CIU)

We, the undersigned, urgently demand that the Harris County District Attorney’s Conviction Integrity Unit (CIU) investigate the wrongful conviction of Darius Elam. The case against him is built on lies and suspicious police conduct, and the evidence proving his innocence can no longer be ignored.

A Conviction Based on Lies
In 1984, Darius Elam was sentenced to life in prison for aggravated robbery, a crime he did not commit, and he has consistently maintained his innocence. His conviction rested on the testimony of a paid jailhouse informant, someone with a proven history of lying for leniency, and a manufactured yellow sheet of paper, supposedly bearing a single fingerprint, which mysteriously appeared in the victim’s car three months after three other investigators had examined it and found no yellow sheet of paper. There was no physical evidence linking Darius to the crime. The prosecution’s case relied solely on the fabricated testimony of informants and the questionable yellow sheet.

Furthermore, Clarence Richardson, who possessed the victim's credit card and ID (with his photo superimposed over the victim’s), stated that Darius had no knowledge of how he obtained them or that he was using someone else's credit card. Despite Richardson's possession of the victim's belongings and his denial of Darius's involvement, Richardson served only three years for credit card fraud, while Darius received a life sentence. These lies destroyed Darius Elam's life.

The Truth Emerges: DNA Evidence Excludes Darius Elam
In 2014, new DNA testing confirmed that Darius was not the source of the DNA found at the crime scene. Instead, DNA under the victim’s fingernail identified an unknown third party as the likely perpetrator.

Suspicious Police Misconduct
A reported yellow sheet of paper, allegedly with blood spatter, was inexplicably destroyed by the Harris County Clerk in 1995, while all other original crime scene items—bullets, shoes, clothing, fingernail clippings, hair, and blood samples—were preserved. The selective destruction of this potentially crucial piece of evidence raises serious questions. Unable to test the yellow sheet, DNA testing was conducted on the remaining items, and Darius was excluded as a contributor.

The prosecutor’s case hinged on this suspiciously reported yellow sheet, purportedly taken from Darius’s notebook and planted in the victim’s car by one investigator three months after the original crime scene investigation, documentation, and sign-off by three other investigators who did not find or report any such yellow sheet. Photos of the original crime scene also did not show any yellow sheet, nor did the crime logs. This compelling, yet ignored, evidence should compel an exoneration after over 40 years of imprisonment.

A Critical Breakthrough: The Informant Admits to Lying
In 2021, the informant who helped convict Darius came forward and admitted to lying under oath. He confessed to fabricating his testimony to secure a reduced sentence. In 2022, an HPD sergeant testified in court that the informant admitted to lying about Darius confessing to the murder and theft. Despite this pivotal recantation, Darius remains incarcerated. The system has failed to act on this truth, denying justice to an innocent man.

What’s at Stake
As Dr. Martin Luther King, Jr. stated, “An injustice anywhere is a threat to justice everywhere.” Allowing this wrongful conviction to continue sends a dangerous message: that the truth is irrelevant, and innocent people can remain imprisoned if the system refuses to correct its errors. Darius Elam is not only fighting for his freedom but also for the integrity of our entire justice system. A failure to investigate this case is a failure to rectify the systemic mistakes that disproportionately harm innocent Black individuals.

Why Now?
We can no longer wait. Darius Elam has been denied justice for over 40 years. The evidence proving his innocence is clear: the DNA test results, the informant’s recantation, and the absence of any credible evidence linking him to the crime. This case should have been reviewed years ago. The Harris County District Attorney’s Conviction Integrity Unit has the power and responsibility to rectify this injustice, and it must act now.

We Urge the CIU to Take Action

  • For public safety, review the DNA evidence that excludes Darius and identifies another suspect.
  • Investigate the informant’s recantation and its impact on Darius’s conviction.
  • Examine the destruction of the reported “Yellow Sheet of Paper” and the reasons behind the destruction of this potentially exonerating evidence.
  • Take immediate action to rectify this wrongful conviction and free Darius Elam.
