Call for review of judicial conduct during a high court hearing

The Issue

I am writing this petition due to a troubling experience I faced during a recent High Court hearing. While exercising my lawful right to approach the court, I was met with remarks that left me deeply concerned.

According to my experience in open court, I was told to “leave the executive alone,” that “there is no such thing as active citizens,” and that I should “leave Parliament to do their work.” I was further told that I am “not a knight in shining armour,” that “the public must know their place in society,” and that the court would “make an example of me.”

As a citizen who believes in the importance of active civic participation and accountability in a constitutional democracy, these remarks were deeply unsettling. Statements of this nature, if accurately reflected in the official record, risk undermining constitutional values and may discourage ordinary individuals from approaching the courts to seek justice or hold those in power accountable.

Following this experience, I submitted a complaint to the Judicial Service Commission (JSC). However, my concern is that the matter was not addressed in a substantive or objective manner. The response I received indicated that the JSC does not have the mandate to review court decisions and that there are other avenues available to pursue the matter.

While I understand the distinction between reviewing judicial decisions and judicial conduct, my concern relates specifically to the conduct and remarks made in open court, which I believe deserve proper and independent consideration. The principle of separation of powers is fundamental to our democracy, yet the comments made during this hearing, in my view, appeared to dismiss the role of citizens in holding the executive accountable.

I further attempted to raise this issue through higher legal channels; however, I was not afforded the opportunity for this matter to be meaningfully addressed. This has left me with serious concerns about access to justice and the ability of ordinary citizens to have their constitutional rights fully considered.

It is essential that all citizens feel heard, respected, and treated fairly in a court of law, especially when exercising their constitutional rights. The judiciary is a cornerstone of our democracy, and its impartiality, independence, and commitment to constitutional principles must be preserved at all costs.

Any conduct that could be perceived as discouraging civic participation or limiting access to justice risks eroding public confidence in the legal system. For this reason, a transparent and independent review of the conduct during these proceedings is both necessary and in the public interest.

I urge the relevant authorities to conduct a thorough review of this incident, including the official court record, to determine whether judicial conduct was consistent with constitutional principles and judicial ethics.

By doing so, we can help restore and protect faith in our judicial system and reinforce the principle that every citizen has the right to seek justice and to participate meaningfully in our democracy.
