Call for a Unified National Data Privacy Law to Simplify Compliance and Support Business
The Issue
Our prevailing state-issued data privacy laws are causing unnecessary complexities for businesses. Attempting to comply with various state-level regulations often leads to misunderstandings, compliance issues, and significant hindrances to business growth. For instance, as of October 1, the Montana Consumer Data Privacy Act (MTCDPA) has been enacted, adding yet another regulation businesses must acquaint themselves with. This growing patchwork of state-specific laws is overwhelming for businesses and places an undue burden on their ability to innovate and operate efficiently.
In 2025 alone, the following state privacy laws will take effect:
- Delaware Personal Data Privacy Act (DPDPA) – January 1
- Iowa Consumer Data Protection Act (ICDPA) – January 1
- Nebraska Data Privacy Act (NDPA) – January 1
- New Hampshire Data Privacy Act (NHDPA) – January 1
- New Jersey Data Privacy Act (NJDPA) – January 15
- Tennessee Information Protection Act (TIPA) – July 1
- Minnesota Consumer Data Privacy Act (MCDPA) – July 31
- Maryland Online Data Protection Act (MODPA) – October 1
While the intent behind these laws is to protect consumer privacy, the lack of uniformity between them creates unnecessary legal complexities. Businesses, especially small and medium-sized ones, are facing growing challenges in trying to navigate the intricate differences between state laws. This leads to compliance issues, added costs, and stifled business growth.
It is crucial, not only for business efficiency but also for robust and uniform privacy protection for all citizens, to streamline these varying policies into a single national data privacy law. A centralized regulatory approach would provide businesses with a clear, straightforward checklist for maintaining compliance, rather than forcing them to deal with the confusion and uncertainty of a patchwork of legal frameworks.
A National Data Privacy Law would offer the following benefits:
- Simplified Compliance: With one unified standard, businesses can focus on growth instead of juggling multiple state-level laws. A national law will reduce the complexity and costs of compliance, making it easier for businesses to operate across the U.S.
- Level Playing Field: A national privacy law will ensure that all businesses, regardless of size or location, are subject to the same standards. This creates a fair competitive landscape and prevents larger corporations from having an unfair advantage in navigating compliance.
- Consumer Confidence: A national standard will offer consumers the peace of mind that their data is protected consistently, no matter where they are or which company they interact with, ensuring that all citizens receive the same level of privacy protection.
- Business Growth: By reducing the confusion of state-specific regulations, businesses can confidently expand and scale their operations without the fear of non-compliance or legal complications.
In an age where privacy is paramount, it’s time to bring simplicity and effectiveness together to ensure all data is protected, no matter the state boundaries. A national data privacy law will provide clear guidelines for both businesses and consumers, fostering growth and ensuring privacy in a more efficient manner.
