Call for a Special Meeting of the Association for Lawful Decision-Making

The Issue

As unit owners in Kingston Square Association, we have been assessed a special assessment for a material alteration project in our common areas of our community property, a decision that impacts all of us residing in Kingston Square Condominium.

However, the process under which this special assessment was ratified was not sufficiently transparent and many questions in regards to contractor, contract terms and conditions and scope of work exist amongst many association members.

This situation highlights the urgent need for much better communication between board, property management and the direct involvement of all members in decisions that will economically impact all of us unit owners with a financial burden which affects us for over 16 years.

We are not confident that the fiduciary decisions made by the board on our behalf is according to owner rights as stipulated in Florida Condominium State Statute Act that serves to protect owners. 

It is critical to comply and adhere to Florida's Condominium Act, which clearly states that material alterations to the common elements of a condo property require approval by 75% of the total voting interests of the condominium association (Section 718.113, Florida Statutes). 

This is a petition for a special meeting of the association and its owners, requesting to review in writing the evidence provided by association attorney in which there is a "clearing" or legal advisement provided to  the board of directors that declares or defines procedure in Kingston Square condominium bylaws which describes or is specific in regards to procedure(s) for imposing special assessments associated to material alteration in common areas excluding majority owner votes as stipulated in Florida Condominium State Statue.

We need to foster a community that respects the collective interest of each member of our association and compliant with Florida State Statues.
