The local council is considering granting a 'Lawfulness Certificate' to someone whose school, operated by his company, Applied Educational Solutions, was closed by Ofsted for twice 'inadequate' assessments in Enfield.

Why is the council trusting him to manage 24-hour care for vulnerable children after he failed to properly run a daycare? This seems like an exploitation of a system loophole and raises major concerns about children's safety?#EDUCARE SUPPORT LIMITED

"The same person opened a limited company in his wife's name EDUCARE SUPPORT LIMITED
Company number 11699836 to apply for a home for children care , asking for a lawfulness certificate."
Enfield Council,
We, the undersigned, respectfully petition the council to reject the proposed change of use for 115 Mandeville Road, Enfield, EN3 6SH, from C3 (dwelling houses) to C2 (residential institutions) for the following reasons:
1. **Insufficient Parking**: The site features a driveway that accommodates only one vehicle,(*attach photo below) parking , other while the property has 3 bedrooms. With no , employees, residents, and visitors will be compelled to access the property via cars, leading to parking issues. Mandeville Road is busy, implying no available road parking and has significant parking issues, making street parking impossible."
2. **Potential Increase in Anti-Social Behaviour**: A 24-hour operation raises concerns about excessive noise and disturbances, including staff, visitors, and residents accessing the facility at all hours. This could lead to issues such as petty crime and drug/alcohol use, significantly affecting the safety and peace of the young children residing in the local area.
3. **Noise Pollution**: Given this is a terrace property, any noise from the residents of number 115 can be clearly heard in the adjoining properties, posing a continuous disturbance to nearby residents.
4. **Impact on Property Values**: The presence of such an institution can adversely affect property values in the area, potentially leading to financial losses for local homeowners.
5. **Increased Traffic and Noise**: Residential institutions often result in increased traffic, with guests coming and going at all hours. This could lead to significant noise pollution, disrupting the peace and quiet of our family-oriented neighborhood.
6. **Restrictive Covenant Violation**: The property deeds contain a restrictive covenant stating that "no house should be used otherwise than a private dwelling house." The proposed change breaches this covenant as it involves a private, for-profit enterprise.
7. **Light Obstruction to 117 and 113 Mandeville Road**: The modification and increased activity at 115 Mandeville Road could obstruct natural light to the neighboring property at 113 Mandeville Road. This would significantly affect the living conditions and well-being of the residents due to reduced sunlight and increased shadowing, contravening the principles of the "right to light" act.
8. ** Privacy and Security Issues**: The introduction of a C2 institution could lead to increased foot traffic and visitors, potentially infringing on the privacy of nearby residents and raising security concerns. The presence of unfamiliar individuals and the likelihood of more people coming and going at all hours could disrupt the peace and sense of safety in our neighborhood.Privacy - “Secured by design” recommends commercial CCTV and due to the layout of the , this may impact on residents right to privacy, neighboring not only in daily undertakings but also issues of data control and surveillance.
9. ** Property Values**: Changes in the character of the area could negatively affect property values. Potential buyers might be deterred by the presence of a C2 institution, fearing increased noise, traffic, and other disturbances, thereby potentially leading to a decrease in demand for properties in the vicinity.
10.** Parking and Infrastructure Strain**: A C2 institution will likely require significant parking space to accommodate staff, visitors, and service providers. Our local infrastructure, including streets and public transportation, might not support this additional burden, leading to congestion and inconvenience for current residents.
11.**Impact on Local Services**: The introduction of a new institution could strain local services such as healthcare, police, and emergency services. This strain might result in longer response times and less availability of resources for existing residents, thereby affecting the overall quality of life in the area.
12.**Historic and Aesthetic Considerations**: If our community includes historic or aesthetically unique elements, the construction or conversion of a property to C2 use could undermine these aspects. Preserving the historic and visual integrity of our neighborhood is essential to maintaining its charm and value.
13.**Concerns Over Future Use**: Designating the unit for C2 usage today makes it easier to transfer it to another use class in the future ,C2A, such as residential care ,detention centre or young offenders institution, further complicating and impacting the community adversely.
In conclusion, while the development of a C2 institution might bring certain benefits, the potential negative impacts on our community's environment, character, property values, and local infrastructure suggest that it is not a suitable addition. We urge careful consideration of these factors before approving any changes.
We kindly request that the council take these points seriously and consider the substantial impact this reclassification would have on the current residents. We believe that maintaining the current C3 classification is in the best interest of our community’s well-being and harmony.
Thank you for considering our perspectives on this matter.
Sincerely,
Neighborhood,
