The Issue
Protecting Stability in Irish Citizenship Reform
Proposed changes to the Irish Nationality and Citizenship Act would extend general residency requirements for naturalisation from 5 years to 8 years, and for spouses of Irish citizens from 3 years to 5 years. While immigration policy needs to evolve, changing the rules midway creates deep uncertainty for thousands of working people, parents, and spouses who made life-changing decisions based on the law when they arrived.
Kranthi Ireland calls on the Minister for Justice and the Oireachtas to ensure fairness, stability, and legal certainty are built into any citizenship reform through clear transitional protections and practical safeguards.
Why This Matters
Thousands of immigrants live in Ireland, working in our hospitals, nursing homes, construction sites, public transport, local shops, and tech hubs. They pay taxes, pay rent, raise their children, and contribute daily to the fabric of Irish society.
People planned their lives, careers, and family futures around the existing legal framework. Changing these requirements without protecting those already on the path to naturalisation unfairly penalises people who have followed every rule.
Furthermore, applicants regularly face administrative obstacles beyond their control—including severe Irish Residence Permit (IRP) renewal backlogs, processing delays, and historical disruptions like COVID-19 travel restrictions. These issues must not be used to discount a person's lawful residence.
What We Are Requesting
We call on the Minister for Justice and the Oireachtas to ensure that any proposed reform includes the following five protections:
A Clear Transition Period (Grandfather Clause): People already legally resident in Ireland and spouses who built their lives here under the existing 5-year and 3-year rules must be permitted to qualify under those original timelines.
Protection for Families: Establish clear, predictable, and fair pathways for spouses of Irish citizens and children who have grown up in Ireland.
Fair Treatment for Administrative Delays: Ensure processing backlogs for IRP renewals and administrative delays do not reduce a person's recognized period of continuous residence.
Accessible Language and Civics Requirements: If new integration tests are introduced, the State must provide free, clear study materials and accessible testing conditions.
Fair Financial Criteria: Any financial or self-sufficiency requirements must account for standard life events, including maternity leave, temporary illness, caregiving responsibilities, or disability.
