The Issue

Jamey DiDomenico is a father of two who is currently serving a 10-year prison sentence in Tennessee after a deeply contested case that his family, friends, and supporters believe raises serious concerns about fairness, due process, impartiality, ethical conduct and possible corruption. Supporters are asking for a careful, independent review of the case to ensure that the legal process was handled fairly, impartially, and in full accordance with constitutional protections. For more than 20 years, Jamey built a respected career in Nashville’s film and creative community as a sought after Production Designer and Art Director, working on movies, television shows, commercials, music videos, print campaigns for a multitude of celebrities and national brands.                                               His website:  www.nashvillefilmdesign.com  Most importantly, he was an active, present and loving father.    A provider.  A man deeply rooted in his family and community.    Today, his children are growing up without him.   How This Case Began In January 2021, Jamey discovered inappropriate text messages on a family  iPad between his then wife and one of her male clients while it was being used by their minor child.  Concerned, Jamey documented the messages and confronted his wife.   She denied the allegations and shortly thereafter, she filed for divorce. What followed would change Jamey’s life forever. The Allegations and Immediate Fallout On August 16th, 2021, while the couple was still living together and navigating a highly contested divorce involving child custody, finances, and marital assets, Jamey’s wife of almost 6 years, an experienced divorce attorney, reported an allegation of sexual assault against herself.  The allegation was made less than 24 hours before the couple’s scheduled divorce depositions.   There was no physical evidence. There were no witnesses The claim was uncorroborated. It is important to note that court records and sworn testimony indicate that the parties engaged in consensual relations on multiple occasions during the pendency of the divorce proceedings between March and August of 2021.  The ex-wife acknowledged at least one such consensual encounter during her testimony.   Jamey has consistently denied the allegation and has maintained his innocence from the beginning. An immediate order of protection was issued with no questions asked, giving him just 30 minutes to gather belongings before being removed from his home. Subsequent court rulings, the order of protection, an exorbitant amount of temporary marital support in the amount of $4320 per month, left Jamey and his son, from previous relationship, with no option but to move in with his parents, never able to return to his home again.  He and his son were separated from his young daughter and for over two years they were limited to only a few hours a week of supervised visits with her.       Learn more at www.justice4Jamey.com   The Trial and Conviction Jamey was offered a plea deal that included no prison time but required probation and lifetime registration as a sex offender. Maintaining his innocence and a false allegation, he declined the plea and chose to go to trial to defend himself. "Blessed is the man who remains steadfast under trial, for when he has stood the test he will receive the crown of life, which God has promised to those who love him." ~James 1:12   The trial ~ November 13-15, 2023. The trial took place in the same jurisdiction where his ex-wife practiced law. The case involved no physical or forensic evidence and relied primarily on conflicting accounts. Sentencing Hearing ~   April 3rd 2024 During the Sentencing Hearing, it was noted that Jamey’s ex-wife became engaged on Good Friday, March 29th 2024-just days before the scheduled hearing- to the former client.  The two were married several months later. Furthermore, despite more than 100 supporters appearing at Sentencing Hearing and over 125 character letters submitted on his behalf, Jamey was convicted and sentenced to 10 years in prison without the possibility of parole. An ongoing order of protection also continues to prohibit contact with his daughter. He is currently incarcerated while continuing to pursue legal appeals.   Why Supporters Are Concerned Jamey’s family and supporters believe the investigation and trial raise serious questions that deserve independent review, including:  Withholding and destruction of evidence: The court ordered the exclusion and destruction of critical evidence that would have supported Jamey’s defense. Procedural errors: Documented issues regarding improper jury instructions and denial of a “mistake of fact” defense Witness exclusion: Defense witnesses for  Jamey’s support were excluded from any testimony in the criminal trial. Judicial bias: Serious concerns regarding impartiality, bias, prejudice, interpersonal relations within the Williamson County court system visually witnessed by countless supporters for Jamey. These concerns do not diminish the seriousness of the criminal allegations. However, they underscore the importance of transparency and confidence in the legal process - especially with a lengthy prison sentence is involved.   The Human Cost This conviction has had devastating consequences beyond the courtroom, not only for Jamey, but for his children and family as well. Jamey has lost: His freedom Custody and all communication with his daughter Time resulting to limited visits with his son His career His home The consequences for his children are profound.  Two children have lost daily access to their father.  A brother and sister have been torn apart from each other. Jamey’s daughter has been completely cut off from her father’s side of the family, losing contact with grandparents, cousins, aunts and uncles who once were a consistent part of her life.  A successful career built over decades has come to a halt.  A stable home has been lost; a family unit has been fractured in ways that cannot be measured by a sentence length alone. The long-term impact on his children and family is undeniable!   Where the Case Stands Now Jamey’s appeal was denied by the Tennessee Court of Criminal Appeals with no case law to support the denial (Case No. M2024-01368-CCA-R3-CD).  His legal team has filed an application for review with the Tennessee Supreme Court, and that appeal was also denied with no supporting case law (Case No. M2024-01368-SC-R11-CD. The Court of Appeals affirmed the conviction WITHOUT resolving whether the jury was properly instructed on a recognized general defense. In doing so, it left unanswered a central question of trial fairness and declined to address the legal significance of an asserted instructional omission.   A “mistake of fact” is a defense to prosecution if the ignorance or mistake negates the culpable mental state of the charged offense.” Tenn. Code Ann. § 39-11-502(a). The pattern instruction requires the jury to acquit a defendant if it has “a reasonable doubt as to whether the defendant acted through ignorance or mistake of fact.” T.P.I.-Crim. 40.01. This outcome is deeply troubling. By upholding a conviction without addressing whether the jury was properly instructed on a recognized general defense, the courts effectively sanctioned a process that denied the defendant a fair trial.    Even more concerning, this decision now stands as PRECEDENT in Tennessee.  It may be cited in FUTURE CASES to justify denying defendants proper jury instructions, even where the law clearly requires them.   The danger here extends far beyond this one case. Jury instructions exist to protect against wrongful convictions by ensuring jurors understand the law they are sworn to apply.
