I am pushing to make "non-fatal strangulation a specific charge" and have been for the last 12-18 months.
The Government are not convinced that this is required, I and many professional disagree.
MP Alex Chalk says...
First, there are already several existing offences that can apply to cases involving attempted strangulation. These cover a range of seriousness from attempted murder to common assault and battery."
"There is also a specific offence under 21 of the Offences against the Persons Act 1861 (the 1861 Act) which makes it an offence to attempt to choke, suffocate or strangle any person, or to choke suffocate or strangle a person in an attempt to render a person insensible, unconscious or incapable of resistance. In addition attempted strangulation can also be part of a course of action under the coercive and controlling behaviour offence".
Recent figures reveal that between 3 December 2018 and 28 February 2019, Police charged 416 people with strangling or suffocating their partners – that is around 33 people per week and almost five each day. I am sure this is not the true figures.
Studies have shown that if a victim is strangled by a partner, then they are seven times more likely to be murdered later by that same partner.
The current strangling law is "not fit for purpose" and prosecution is "very rare". This is because use of this law requires proof that the strangling took place in order to carry out another act of violence, such as rape or assault.
