How are the QBCC regulating the industry & protecting home owners, trades & companies from being caught in the sphere of this type of conduct breaching their industry.  How many other consumers have been ill informed due to the QBCC failings by taking 11 months to investigate their 'Notice of Offence', substantiated offences and then under the QBCC Act 1991 only issue 1 out of 5 offences with penalty points and a fine. 

In the QBCC Act the word "must" reflects an action and outcome, but the QBCC has used a 'discretion' which I feel is inappropriate especially as there are 5 offences so far:

  1. Schedule 1B, Section 16 Copy of commencement notice - QBCC Act 1991
  2. Schedule 1B, Section 33 Deposits - QBCC Act 1991
  3. Schedule 1B, Section 34  Progress payments for regulated contracts - QBCC Act 1991
  4. Schedule 1B, Section 40 Variations must be in writing - QBCC Act 1991
  5. Schedule 1B, Section 42 Extension of time QBCC Act 1991
