Maintain Boatworks As A Peaceful, Residential Community

The Issue

The Boatworks Community was conceived in 2002 as a Residential Community with 160 Townhomes, a Public Riverwalk and a attached 62 Slip Boating Marina with 31 Parking Spaces for Marina Guests and Public Riverwalk Access.

This year, the independent owner of the Elco Marina, in violation of the Master Deed and Bylaws of Boatworks as well as the Zoning Laws of Bayonne, embarked on a scheme to expand the use of the Boating Marina to include Jet Ski rentals; operated by a third party company, Fly Jet Ski.  This expanded use has created numerous quality of life issues for the owners and residents in and around Boatworks.  While 31 parking spaces may be adequate for a 62 slip Boating Marina and Public Waterfront access, they are wholly insufficient for hourly rentals of 15+ Jet Skis in addition.  The Marina owner has assured of even more Jet Skis if this scheme is codified.

Residents have had to endure increased daily traffic, speeding, trash, trespass, vandalism, noxious fumes and noise as early as 8 AM up through and past 10 PM.  Additionally, multiple health and safety issues persist with unlawful transportation and storage of fuel for both Jet Skis and Boats, unsecured dock gates and the general disrepair of the Marina itself. The Owners of the Elco Marina and Fly Jet Ski have rebuffed all attempts by the Elected Board and Management to alleviate the burden to residents engaging in threats and intimidation and bullying. On May 26, 2021 a cease and desist was ordered by the Zoning Officer and multiple violations issued by the Fire Inspector. These were all ignored and business continued as before.  

We, the Residents of Boatworks and concerned citizens of Bayonne, strongly object to the efforts by both Fly Jet Ski and the Elco Marina to have the Bayonne Zoning Board of Adjustment legitimize and expand the use of this Boating Marina for the purposes of operating a Jet Ski Rental business in contravention of the governing documents of the Boatworks Community and the original Zoning Approval sought by the developer upon conception of the community.
