Banning & Regulating Data Centers in Gilroy

The Issue


The people of Gilroy demand that the City of Gilroy change the zoning ordinance to ban further construction of Data Centers within Gilroy. Along with this, we also demand that a third party expert in the research of data centers, who does not have a vested interest in any corporation making these data centers, be hired to communicate between the project applicant and the community. This third party would be tasked with ensuring that the community's issues are heard, and safety measures can be implemented if impacts to public safety or the environment are found regarding the current Data Center within Gilroy.  Additionally any data centers would be required to collaborate with the city and the power company to ensure that the use of energy does NOT roll over to the residents energy bill due to the demand these data centers cause. Along with this, they must use only recycled water through the entire lifespan of the data center, and collaborate with the city and water infrastructure to ensure no amount rolls over to the residents water bill due to the high demand.

Under the current zoning code of Gilroy, a Data Center being made within Gilroy's industrial district does not require a vote and instead goes only through the Community Development Director Sharon Goei. And because this does not require a vote, these Data Centers are able to slip by without the public's knowledge, delaying the pushback until ground is already broken, leaving it too late to stop the construction itself. 


These Data Centers can affect everyone within the city they are built. The current Data Center within Gilroy is set to use 7.5 million gallons of clean drinkable water per year according to the city's website. Along with that, it will be using 49 MW of power which is equivalent to 20,000 homes. The increased demand for power and water will then be pushed onto the people of Gilroy with increased utility bills and more frequent power outages. 


Over a thousand residents of Gilroy and neighboring communities already have shown their concern for these Data Centers, a previous petition regarding them showing this fact with nearly one thousand and seven hundred signatures. The City of Gilroy will hear its people. No more Data Centers in Gilroy, not now, not ever. Stop the bleeding.

Thank you for all of your concerns and for becoming more engaged. The grading permit and underground utilities permit were issued, and this project has already broken ground. I’d be willing to talk with anyone on how developments are planned and approved. Not all permits and projects come before City Council or City Commissions but that doesn’t mean they haven’t had a public process that was followed to reach the approval at staff level. If you want to change city code, there's a process for that. There's a process for everything. Sharon Goei is the Community Development Director and has full authority for the approval of Architectural and Site Review Permit AS 20-23 application once complete. Planning Staff in her department reviewed the project for compliance with the applicable review criteria, pursuant to Zoning Code Chapter 30, Section 30.21.10 of the Gilroy City Code. That's the code that provides her the power and, in that code, it also states that Data Processing Establishments are unconditionally permitted (meaning they don't need to get planning commission or city council approval if they are located on land zoned already for them). This project went through a public process called CEQA or the California Environmental Quality Act. It is a 1970 state law requiring California public agencies to review, disclose, and mitigate significant environmental impacts of their proposed projects, ensuring transparency and public involvement in government decisions to prevent avoidable environmental damage. It mandates agencies to "look before they leap," identifying potential effects, exploring alternatives, and implementing measures to reduce harm before project approval, often through documents like Negative Declarations or Environmental Impact Reports (EIRs). There are many ways to stay in touch with the actions of the City of Gilroy and there are multiple ways that the City of Gilroy, City Council, and City Commissions provide updates.
