Ban seclusion rooms without consent nationwide

The Issue

My son was held shut in a seclusion room for punishment and the staff's convenience without my knowledge nor consent. He was coerced into the room and, when he requested to use a tool that is always made available to him due to his Individualized Education Program (IEP), he was denied. He was told he didn't need it, even though it's a recognized support. He didn't pose any imminent danger or harm to himself or others until he was locked in by three principals. I had never seen my child so terrified, and now he is afraid to go to school.

This ordeal is not just an isolated incident; it highlights a critical issue facing our educational systems nationwide. Seclusion rooms are being misused as a method of punishment, often for the convenience of staff, and sometimes without parental knowledge or consent. This misuse can cause significant emotional and psychological harm to children, leaving lasting impacts on their wellbeing and attitudes towards school.

Seclusion rooms are meant to be a last resort, used only when a child poses an imminent danger to themselves or others. However, without strict regulations and parental involvement, they are too often used inappropriately. It is essential that parents and guardians give consent and are notified if such extreme measures need to be taken. Transparency is key to ensuring our children’s safety.

According to a 2015 U.S. Department of Education report, over 100,000 students were subjected to seclusion or restraints during that year, and students with disabilities are disproportionately affected. This statistic underscores the urgency of addressing this issue to protect all students, especially those most vulnerable.

By banning the use of seclusion rooms without parental or guardian consent in both public and private schools nationwide, we can foster a safer and a more trusting school environment for our children. Schools must also be encouraged to seek alternative de-escalation methods that are more humane and respectful.

We urge the Department of Education to implement a nationwide policy prohibiting the use of seclusion rooms without prior informed consent from a parent or guardian. This change will ensure that our children are treated with dignity and respect, and that their education is not a source of fear and trauma.
