Ban Noncompete Contracts Nationwide, Let Innovation Thrive! In Medical, Big Tech etc…
The Issue
Back in September 2025 the FTC surrendered its fight for a nationwide ban on worker noncompete contracts--
(2 demands in Caps below -2nd related)
quote:
“The Trump Administration just handed corporations a license to trap workers in bad jobs.”
1) WE DEMAND THE TRUMP ADMINISTRATION RECONSIDER AND BAN NONCOMPETE CONTRACTS NATIONWIDE!!! (2nd demand below)
Tech and so many areas could blossom with a noncompete contract ban. We at DialysisEthics2.org have a specific medical example where a nationwide noncompete ban would be a great start! Innovations like 'Community Dialysis Houses' in kidney dialysis are being stifled by noncompete contracts - this has happened along with other factors. (one is mentioned below) The news organization Politico had an excellent example of how doctors and staff are locked into their jobs:
Politico article quotes:
"companies make it difficult for the physicians who work in their clinics to leave for rivals and start new businesses"
"noncompete agreements the companies require doctors to sign snarl efforts by rivals that want to make it easier for dialysis patients to be treated at home" (and would add at Community Dialysis Houses[1])
Summary:
Doctors and staff AREN’T free to leave to innovate with such things as ‘Community Dialysis Houses’[1]
*Some Noncompete Contract Detail:
Nephrologists - kidney doctors - are often forbidden to practice inside their geographical area (20-50 miles) for one to two years if they leave many for-profit dialysis companies - stifling innovation.
---------------------------------------------
Some Kidney Dialysis Background:
(and why innovation is desperately needed)
In the year 2000, my daughter was on kidney dialysis, an experience that opened our eyes to the stark realities of the dialysis system. *DialysisEthics.org: Background
----------------------------------------------------------------------
Some Stark Realities:
*Overall view: Latest International Comparisons
*Horrific Stats: even for KIDS!!!
----------------------------------------------------------------------
Another Area for Improvement in Kidney Dialysis:
There are obstacles at the federal level which look to be in the way of kidney dialysis patients getting better care besides noncompete contracts. For one, the fact that nephrologists - kidney doctors - often have a financial interest in many of the for-profit clinics and these doctors would be less likely to recommend something like a 'Community Dialysis House'[1]. NEPHROLOGISTS SHOULDN'T BE ALLOWED TO PROFIT OFF THEIR PATIENTS!!! And they couldn't, until they received an EXEMPTION TO THE STARK LAW!!! THE STARK LAW FORBIDS DOCTORS TO PROFIT OFF PATIENTS!!!
2) DEMAND:
TAKE AWAY THE KIDNEY DOCTORS' EXEMPTION TO THE STARK LAW!!!!!
*And if there comes an environment where 'Community Dialysis Houses'[1] could flourish, maybe they could be taken under the wing of a quasi-state entity. The feds have lost trust with many dialysis patients and advocates. That is with the possible exception of the Veterans Administration, there are many veterans who wouldn't be adverse to the VA taking a greater role in civilian care.
***SUMMARY:
***THIS COULD HAVE RIPPLES OUTSIDE OF DIALYSIS - ESPECIALLY WITH A NATIONAL NONCOMPETE CONTRACT BAN!!!!!
[1]'Community Dialysis Houses' where healthier patients can practice self-care with minimal staff - easing the burden on clinics who would be freed up to attend to patients with greater needs. There would also be a cost savings with less expensive overhead. Many rural patients could benefit with less of a distance to travel to a clinic. Urban patients living in cramped rental spaces would also benefit since landlords are often hesitant to put in electrical and plumbing upgrades, and space might be lacking for supplies for home dialysis.
