Charge the baiting driver.

The Issue

In the video showing an HGV overtaking a car on the motorway and then moving back in too early and colliding with the cam car it is very easy to be shocked at the HGV driver and to expect that he be charged and punished, however that is not the full picture. There is no doubt that the HGV driver is wrong and there are at least 2 aspects of his driving that are clearly against the law and not in line with the highway code . The clear aspects are that he initially tailgated the car and then he used lane 3 to overtake, both out of frustration due to the car driver's deliberate actions. The questionable part lies in the collision itself. As you see in the video, the artic accelerates past the car and as the artic is 54 foot long the driver relies upon judgement to return to left following an overtake. This judgement is a mix of what you can see in your mirrors (very little ) and by how much faster your overtake was being completed at, this is why it is dangerous for the vehicle being overtaken to alter their speed during the overtake. In the video it is clear that the car driver accelerated to match the lorry speed in what only can be described as a deliberate attempt to annoy the HGV driver and hold him out in lane 3. This clearly works and the HGV driver makes attempts to usher the car into the correct lane. It is questionable wether the HGV driver intentionally collided with the car or he misjudged the length. I certainly wouldn't understand the mindset of any driver who intentionally collides with anything, knowing what impact it would have on his/her livelihood. Another interesting fact to note during the collision is that the car driver has a clear live lane 1 and hard shoulder to his left, he can also brake, however makes no attempt to avoid the collision whatsoever and only moves to the left after the second time that he has baited the HGV. Any normal person would have moved left whilst braking and would have easily avoided any collision... there is no need for heavy braking or heading deviation to avoid the lorry so it's not like it would have taken much. This puts my focus firmly onto the car driver. He is hogging the middle lane 2, he is going slower than the approaching traffic from behind which are HGVs limited to 56mph (considerably less than the 70mph limit) he refuses to return to the left on their approach and continues to refuse to return to the left throughout. He continues to bait and agitate the following HGV driver who is now making it clear that the car driver is holding him up ( thus holding the whole carriageway up and creating a bottlneck). He then speeds up during the HGV drivers overtake to match the HGVs speed and to prevent the HGV from returning left, thus putting everyones safety at risk. He then fails completely to take evasive action, which any normal competent driver would have taken to avoid a collision. In Summary, there is no defending the HGV driver's poor judgement in how he chose to handle this situation and it is accepted that he is in contravention of the law in at least 2 minor respects however, I petition that it is about time that the police take a harder look at the behaviour of 'cam cars' as it seems a good majority of them are now looking to create confrontation on our roads. Wether this is for insurance fraud purposes or for internet fame it is the case that these 'incidents' are being orchestrated and it is worrying that they are getting away with such recklessness. I put it to you that the real problem in this video was the 'cam car'. He deliberately held the middle lane.. he knew or ought to have known that he was holding up the traffic from behind. He dangerously matched the speed of the overtaking HGV for no other reason than to bait it and cause confrontation. He deliberately did not take evasive action to ensure that a collision took place and only then slowed down to make his, clearly exaggerated, call for help. The motive aside, the car driver clearly baited, and antagonised another road user in an incident fully orchestrated by the car driver. The HGV would have passed without incident had the car driver been driving appropriately and in line with the highway code. I hope to see the car driver be charged with 'careless driving' and I hope to see a crackdown by Police against similar 'dash cam cars' who are clearly creating incidents on our roads. It now takes a rather sinister tone when you wonder why the car driver was baiting the HGV and why he did not take that evasive action. It seems that, a month before christmas, the car driver has a motive to create an incident bad enough that it will gain media interest and no doubt see a rise in sales for his dash cam selling business. I put it to you that there is a number of suspicious facts surrounding this incident. Why was he driving so slow in lane 2 of an empty motorway at night? How long was he continuously agitating this particular lorry driver for, prior to the collision? Why didn't he make the evasive maneuvers that any other person would have? Why did he overtake and repeat it again? Put this together with his business interests. All he had to do was pester an HGV driver long enough for a reaction and he had his perfect company advertisement. I put it to you that this man should be punished.
