The Issue
Goal: Ask The DOJ Investigate Section 242 Title 18 and 14th Amendment Violation
Sean and Khanisa Darby are local business owners of The Pudding Bar based in Easton, Pennsylvania.
After being injured, losing their home, and business; all on the same premises, The Darbys have been retaliated against for speaking out.
After the City of Easton turned their backs on code violations, and public health and safety issues- the Darbys met City Council at City Hall to raise awareness and request the City of Easton to step in.
Since, the Darbys have been denied access to violation reports while the city also allows structural damage to continue without repair.
The retaliation persisted with an illegal lockout on The Pudding Bar executed by the Northampton County Sheriff in concert with the Northampton County Prothonotary without prior notice or a hearing, which is not only required by Pennsylvania law, but by our Constitution.
Sean and Khanisa’s 14th Amendment right to Procedural Due Process was violated when their Business Premises and Possessions were illegally confiscated without an order from a judge. The Sheriff Deputy, Prothonotary Deputy Clerk, Two Attorneys and the developer have conspired together to suppress the truth, oppress the Darbys all while acting under the “color of law”.
As painful and devastating as the past two years have been, The Darbys have heard stories equally as devastating from many members of their dedicated local customer base and from the local community over all.
There is truly power in numbers and the hope for positive change in the Lehigh Valley is why the Darbys are hoping you sign this petition. Using our voices collectively is one of the best ways to create the change we seek.

DEPRIVATION OF RIGHTS UNDER COLOR OF LAW
SUMMARY:
Section 242 of Title 18 makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States.For the purpose of Section 242, acts under "color of law" include acts not only done by federal, state, or local officials within their lawful authority, but also acts done beyond the bounds of that official's lawful authority, if the acts are done while the official is purporting to or pretending to act in the performance of his/her official duties. Persons acting under color of law within the meaning of this statute include police officers, prisons guards and other law enforcement officials, as well as judges, care providers in public health facilities, and others who are acting as public officials. It is not necessary that the crime be motivated by animus toward the race, color, religion, sex, handicap, familial status or national origin of the victim.
The offense is punishable by a range of imprisonment up to a life term, or the death penalty, depending upon the circumstances of the crime, and the resulting injury, if any.
