In the State of Delhi, when any woman complains to police against her husband or relatives, the Crime Against Women (CAW) Cells get involved and try to patch up or attempt to make a monetary "settlement" and divorce.

This is simple subversion of Judicial Process and also this is the breeding ground for corruption and other illegal activities. 

The police must file a First Information Report (FIR) as soon as there is a complaint. Based on the evidences, they should decide which sections of Indian Penal Code to be applied.

If a woman is complaining against her husband or his relatives, then police must immediately file FIR. Then, based on evidences submitted by the complainant, police can proceed with investigation, applying various sections of IPC or they may even submit B-Report, if the allegations are found to be baseless.

If police finds allegations against husband and his relatives as baseless or minor family tiffs, then they can direct the woman and her parents to family courts, which are created for this purpose only.

Why the time of Crime Against Women (CAW) Cells and the employed police staff is wasted by trying to mediate between a wife and husband, while it is the job of Family Courts and State Legal Services Authority?

The following are complaints against Crime Against Women (CAW) Cells:

1)The police officials at CAW cells pressurize the husband and his parents for an out of court monetary settlement with the threats of jailing under section 498a and subsequent harassment. This is gross misuse of police powers. Any mediation must be done by mediation cells of Family Courts, not by the police.

2) There are incidents of violence and lynching against husbands and his parents in presence of police officials.

Please note, it is not acceptable to use threat of bad laws to force tax paying citizens of the nation as this is nothing but extortion. It is well known that such methods by police have corrupt processes in the backgound, where the officials involved in mediation process tend to look for a commission from the out of court settlement money between husband and wife.

It is to be noted that there is a massive cancerous spread of commission business in mediation process of Marital Problems today, all over India. This is nothing but exploitation of helplessness of common people (aam aadmi) to extort them and mislead women into filing false cases. Several Higher courts have warned about lawyers promoting misuse of laws.

So, we demand Mr.Arvind Kejriwal, the Chief Minister of Delhi and also Somnath Bharti Law Minister of Delhi to instruct the Family Courts to intervene and take over all the mediation process. The police and the Crime against Women (CAW) cells must not be given any powers to mediate between a husband and a wife.

The crime against women cells can file FIR if a woman complains. But, it is disgusting if they are involved in any mediation process in cases of domestic violence, cruelty, rape or sexual harassment. The job of police is to implement laws, not to do mediations and settlements between the accused and the complainants.
