Appeal Against Delhi High Court Order on Mass Relocation and Confinement of Stray Dogs
The Issue
🐾 Protect India's Stray Dogs: Stop Unlawful and Unethical Relocation!

✍️ Why This Petition Matters

We, the concerned citizens of India, urge the Supreme Court of India to take immediate suo motu cognizance of a deeply troubling directive recently issued by the Delhi High Court, which instructs the Delhi Government to formulate a policy for the “institutional rehabilitation” of stray dogs.
While the term “rehabilitation” may sound compassionate, in reality, this directive paves the way for mass removal, disappearance, and even death of community dogs from our neighborhoods — a move that is not only inhumane, but also unscientific, unconstitutional, and legally flawed.
🚫 What’s Wrong With This Policy?
1. It’s Inhumane and Scientifically Flawed
Mass relocation and confinement of stray animals:
- Causes extreme suffering to animals
- Disrupts their natural territorial behavior
- Triggers the "vacuum effect", leading to more dogs entering the area, more aggression, and more uncontrolled breeding
- Global studies and best practices confirm: relocation and culling do not reduce stray populations.
2. It Violates the Supreme Court’s Own Ruling (9 May 2024)
The Hon’ble Supreme Court recently banned the culling, relocation, and confinement of stray dogs, upholding the Animal Birth Control (ABC) Rules, 2023, and directing all States and Union Territories to act within the spirit and mandate of the Prevention of Cruelty to Animals Act, 1960.
The Court also reinforced the five internationally recognized animal freedoms, including:
1. Freedom from hunger, thirst, and malnutrition.
2. Freedom from fear and distress.
3. Freedom from physical and thermal discomfort.
4. Freedom from pain, injury, and disease.
5. Freedom to express normal patterns of behaviour.
3. It Undermines the ABC Rules, 2023
These rules – notified under the Prevention of Cruelty to Animals Act – clearly prescribe scientific sterilization and immunization as the only lawful and humane method of stray dog population control. The proposed relocation policy violates both the spirit and the letter of these rules, and risks undermining the progress made so far in public health and animal welfare.
🌍 Better Alternatives Exist — and They Work
Countries like:
🇳🇱 Netherlands have no stray dogs, thanks to nationwide sterilization, strict animal welfare laws, and community engagement
🇧🇹 Bhutan, 🇹🇭 Thailand, 🇨🇭 Switzerland manage stray populations through science, compassion, and enforcement — not cruelty
✅ Our Demands
We urge the Hon’ble Supreme Court to:
- Reaffirm its 09.05.2024 judgment: Ban all relocation, impounding, or culling of stray dogs nationwide.
- Enforce the ABC Rules, 2023: Mandate sterilization, vaccination, and proper identification (microchipping/tagging) of community dogs.
- Create a National Stray Dog Management Framework:
Central database of sterilized dogs
Mandatory community tracking using GPS collars or tags - Promote Adoption & Regulate Breeding:
Tax commercial dog breeding to encourage adoption
Strict breeder licensing and inspections - Recognize & Protect Caregivers:
Legal recognition of community dog feeders
Connect caregivers with local vets for coordinated ABC programs
Launch compassion-based public awareness campaigns
