Rochester, N.Y. (WHAM) - The Rochester man accused of shooting and critically injuring his two-year-old son Friday completed his parole just two weeks before the shooting.
Charles Phillips, 34, is charged with first degree assault and second degree criminal possession of a weapon after he allegedly shot the toddler inside his Walnut Street home.
Court documents filed Saturday state the charge of first-degree assault against Phillips accuses him of "recklessly engag[ing] in conduct which created a grave risk of death to another person, and thereby causing serious injury to another person."
Investigators found a Century Arms Canik 9mm pistol in the basement of the home on Walnut Street. The pistol was loaded with nine rounds when it was discovered, according to the criminal complaint.
The boy, Zayden Phillips, remains in guarded condition at Strong Memorial Hospital Monday afternoon. He has a "life-threatening brain injury," according to court documents.
At a press conference Friday, Rochester Police Chief Michael Ciminelli did not speculate what led to the shooting, but did say the father and son were the only two people inside the home at the time.
Charles Phillips most recently completed parole after serving out two-thirds of his sentence for first-degree attempted robbery. He was released on parole on April 7, 2015, but was re-arrested less than four months later due to a failure to adhere to parole conditions. He was later re-released on April 7, 2016 and completed his parole on October 7, 2017.
